Van Buren County Car Accident Lawyers

A Van Buren County car accident left a tow truck driver injured while he was responding to a separate accident on December 22, 2008.  Art Haynes, a driver for Harbor Towing, was hit by a car while operating the rear loading controls on his tow truck in response to an accident near South Haven on I-96.  The car that hit him narrowly missed hitting a state police trooper as well.  It appears Art Haynes suffered only minor injuries.

I am sorry this accident occurred.  I hope Art Haynes is able to recover fully from his injuries.

Even though this accident was caused by icy roads, the Michigan No Fault Act still applies.  No Fault insurance will cover medical expenses and a portion of his lost wages, if he has to miss work because of injuries from the accident.  Although these benefits are all that many accident victims file for when their injuries are minor, Art Haynes and others injured in similar accidents should be aware that medical expenses and wage loss benefits are only two of several claims an accident victim can submit to his or her insurance company.

Van Buren School Bus Accident

A Bangor school bus accident has left a student with a possible neck injury.  The accident occurred on December 19, 2008 on the route home from school.  The school bus was stopped on 66th Street north of County Road 376 in Bangor Township with its emergency lights flashing when it was rear-ended.  Neither of the drivers were hurt, but 10-year old Morgan Bodtke was taken to South Haven Hospital with a possible neck injury.  None of the other 17 children on the bus were hurt.

I am very sorry this accident occurred.  As the father of young children myself, I can imagine what Morgan Bodtke’s parents are going through.  I hope she is not seriously injured and is able to have a full recovery.

The first thing this family should do is contact a lawyer.  A lawyer can advise them about filing a claim for Michigan No Fault insurance, which will cover all reasonable and necessary medical expenses for Morgan Bodtke.  No Fault benefits may also provide additional benefits, such as attendant care or household replacement services, if Morgan’s injuries are severe enough to warrant their payment.

A lawyer can also advise about filing a possible lawsuit.  Under Michigan law, only people who have been seriously injured may sue a negligent driver.  In this accident, the bus was rear-ended and the car driver received a citation for failure to stop.  Both of these facts work in favor of showing the car driver was negligent.  However, a lawyer could assist the family only after hearing all the facts and circumstances of the accident and knowing all the details about the injuries to determine whether the injuries are severe enough to allow a lawsuit to be filed and to determine whether such a lawsuit could be successful.

Van Buren County Car Accident

A Van Buren car accident has left an 86-year old Decatur man dead and his 16-year old grandson injured.  Daniel Harralson died from trauma suffered in the accident when he tried to make a right hand turn and lost control of the vehicle.  His car collided with a tree.  David Ohns was treated for minor injuries at Bronson/Lakeview Hospital in Paw Paw.  Neither were wearing their seatbelts.

This is very tragic and must be especially hard for the family.  My sympathies go out to them.

My law firm represents people injured in car accidents.  I know that situations such as this one are difficult, but the family should act quickly to submit claims to their insurance companies.  Insurance companies have strict time limits and I have seen far too many families lose some of their benefits for failing to submit their claims on time.

In an accident like this, both the grandfather and the grandson have claims for No Fault benefits that their family can make for them.  Mr. Harralson’s family can get survivor loss benefits which will pay medical expenses and a portion of the funeral costs.  The Ohns family can also get David’s medical expenses paid for and possibly other benefits as well depending on the severity of his injuries.  Even if David is too young to have his own No Fault insurance policy, he is still eligible to receive No Fault benefits as long as someone he lives with has a No Fault policy.
