Warren Hit & Run Accident

A 2-year-old toddler is in serious condition after a Warren Hit & Run Accident that happened on Sunday, May 23rd. The toddler was allegedly struck by a dark colored SUV while getting out of a car at the County Line Antique Flea Market, according to police, around 4 p.m. The driver of the dark colored SUV fled the scene. Police continue to investigate this accident.

I am very sorry to hear about his accident and wish all the injured child a speedy and full recovery.

Michigan car accident victims have a number of legal rights.  For this type of accident, the injured toddler can submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover the toddler’s medical expenses, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured toddler can claim these benefits even if the toddler did not have an automobile insurance policy.

In addition, the injured toddler may be able to file a lawsuit against the person driving the SUV.  The insurance company for the driver must still cover any injuries. In this lawsuit, the injured toddler can claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

If the driver’s identity is not discovered, the injured toddler still has rights under the law. The toddler may be able to file an uninsured motorists claim against his parents own insurance policy or another insurance policy to compensate the toddler for his or her injuries.  It is important to have an experienced Michigan car accident lawyer review the policy to see if they can make such a claim.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.
