Fatal Bingham Township Car Accident

There was a tragic story in the paper today about one person killed and three others injured in a fatal Bingham Township car accident on November 21 in Sanilac County. According to the Michigan State Police, a three car accident occurred when a 44-year-old Snover man was allegedly attempting to turn left onto Spencer from M-19 when he was allegedly hit by a southbound Chevy Blazer, driven by a 64-year old Lapeer man. A third vehicle, driven by a 50-year-old Ubly man, in a 2006 Chevy Impala allegedly hit the Blazer after the first collision.

The driver of the Blazer and his wife were transported to Huron Medical Center where she later died from her serious injuries. Two other passengers from the other vehicles were transported to Huron Medical Center, as well, for treatment of their serious injuries. Police are still investigating this accident and believe that weather and fog may have played a role in this accident.

I am very sorry to hear about this tragic accident and offer the family of the deceased passenger my most sincere condolences and best wishes. I hope that the other injured parties have a complete recovery without any permanent deficits.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, any injured parties can submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured parties can claim these benefits even if they did not have a Michigan automobile insurance policy.

Additionally, for this type of auto accident in Michigan, the family members of the deceased passenger may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injury victims may be able to file a lawsuit against the persons determined to be at fault in auto accident. The insurance company for the driver must still cover any injuries. In this lawsuit, any injured parties and the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased passenger may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident. At the very least, the surviving family and injured parties should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Sanilac County Car Accident

A Sanilac County car accident has resulted in the deaths of two sisters.  The accident happened on December 25, 2008 near State Road and M-46 in Sanilac Township when the driver lost control of the vehicle and drove it into a ditch.  The accident is believed to have been caused by icy roads.  Diane Cass and Donna Walsh were non-responsive at the scene of the accident, but passed away over the weekend.

This is a very tragic accident, especially since it occurred on the holiday.  I want to express my condolences to the family.

Michigan No Fault insurance benefits are available to help cover the costs of this accident.  A No Fault survivor loss claim will provide the families with a portion of the funeral costs and with payments for loss of financial support and loss of household services.  Loss of financial support refers to wages or earned income and household services refers to household chores that the accident victims performed.

In addition, Diane Cass’s estate could sue the estate of Donna Walsh in a wrongful death lawsuit.  Family members are sometimes hesitant to sue other family members, but if the relative being sued is fully insured, the insurance company will cover any damages that are awarded.  The insurance company will also cover the cost of defending the lawsuit.  It is really just the same as suing the insurance company directly, but the final choice about whether to file a lawsuit belongs to the representative of the estate.
