Bridgeport Township Pedestrian Car Accident

A Bridgeport Township car accident has resulted in the death of a Saginaw Township pedestrian.  The accident occurred on Williamson west of Squire on October 28, 2008.  The driver stopped and reported the accident and assisted the police.

This is very tragic and I am sorry this accident occurred.  I want to express my sympathy to this man’s family.

Although this man was not in a car when he passed away, his family is still eligible for Michigan No Fault insurance benefits.  Through a survivor loss claim, the family can receive payments for a portion of the funeral cost, lost wages, and other No Fault benefits.  In addition, because he was killed in this accident, his estate can pursue a lawsuit for wrongful death against the driver.

Ogemaw County Car Accident

An Ogemaw County car accident has resulted in the death of a woman.  Shannon Bentley, 25, of Sault Ste. Marie was tragically killed after experiencing engine trouble on I-75.  Another driver struck her car, which had only been partially pulled over onto the shoulder.  This driver, a 60-year old Tecumseh man, was taken to St. Mary’s of Michigan Hospital in Saginaw and underwent surgery on Monday.  He remains in critical condition.

This is a very tragic accident.  My sympathies go out to the Bentley family and their friends.  I also hope that the other driver is able to experience a full recovery.

My law firm represents people involved in car accidents.  Quite often, people are uncertain of their rights following a car accident like this one.  Both drivers have claims for No Fault insurance, which will pay for all of the male driver’s medical expenses and any lost wages as well as for a portion of the funeral expenses for Shannon Bentley.  In addition, the driver who is determined to be free of fault may have a legal claim against the at-fault driver depending on the severity of his or her injuries.  Since Ms. Bentley died, her injuries are clearly sufficiently severe for her to have a claim, but it would depend on how severe the other driver was injured to determine if he would have a claim.

Mount Pleasant Motorcycle Accident

A Mount Pleasant motorcycle accident resulted in serious injuries to the motorcyclist on Wednesday afternoon.  The accident occurred on M-46 when a Midland woman was attempting to make a left-hand turn and a male motorcyclist from Merrill collided with the rear of the woman’s car.  The motorcyclist had to be airlifted to a Saginaw hospital for treatment.

My sympathies go out to the friends and family the motorcyclist.  Any accident involving a motorcycle and a car can have serious consequences for the motorcyclist, and I hope he is able to experience a full recovery.

The motorcyclist may be entitled to No Fault benefits regardless of who is determined to be at fault for the accident.  These benefits include payment of any hospital bills and medical expenses, payment for household chores the motorcyclist cannot do for himself because of the accident, and payment for any supervised care that he requires after he is released from the hospital.  If he has to miss work, his No Fault benefits would also include a portion of any wages he loses because of the accident.  In addition, he may have a claim against the Midland driver if it is determined he was not at fault for the accident.

Union Township Car Accident Kills Driver

A man was killed in a Union Township car accident last week.  Initial reports from the Saginaw Chippewa Tribal Police indicated that a Native American man was killed in a one-car accident.  The driver of the car was pronounced dead on the scene while his passenger was seriously injured.  He was taken to Covenant Hospital in Saginaw for treatment.  Although it appears that no other car was involved in this accident, its causes are still under investigation.

It is always incredibly tragic when a car accident cuts short a life.  My sympathies go out to the driver’s family and to the passenger’s family.  I also want to wish the passenger a full and speedy recovery.

I represent injured car accident victims and their families.  In a case like this, one of the first things both families should do is to determine what type of insurance benefits they may receive.  They will want to do this quickly so that they can gather all the documents they will need to submit to their insurance company to qualify for their benefits.  They should do this quickly because strict time limits often cut off benefits accident victims and their families would otherwise be entitled to receive.

Both drivers have a claim for No Fault benefits.  For the passenger, this will include payment of all medical bills, payment of a portion of lost wages for any time he must take off work, and household replacement services, which is payment for the cost of doing chores around the house that the injured passenger can no longer do himself.  He may also qualify for attendant care benefits if he requires prolonged care or supervision once he is released from the hospital.  Depending on the severity of his injuries, the passenger may also have a claim against the driver for negligence.

For the driver, his family is entitled to receive survivor loss benefits.  These will include a portion of the funeral expenses, so the family should save all receipts from the funeral and related expenses.
