Royal Oak Multiple Hit & Run Accidents Fatality

There was a tragic story in the news today about Royal Oak Multiple Hit & Run Accidents Fatality. A drunk driver, in a Chevy Silverado, was allegedly involved in two hit and run accidents in matter of 10 minutes, according to Michigan State Police. The first hit and run accident allegedly occurred at a McDonald’s on 11 Mile Road near Van Dyke that left several people seriously injured.

State Police said the drunk driver then allegedly rammed into a Ford Aerostar minivan on the Woodward exit ramp of I-696 causing the minivan to roll, 10 minutes later. One of the passengers was killed when the minivan rolled. The driver and other passengers of the minivan were taken to Beaumont Hospital with serious injuries. The drunk driver fled the scene of the accident but was apprehended later when he returned to the scene. Police are still investigating this accident.

I  am very sorry to hear about these tragic auto accidents and wish all the injured parties the fullest and speediest recovery possible.  My condolences to the family of the deceased passenger for their loss.

Our Michigan car accident lawyers advise accident victims their legal rights. For this type of auto accident in Michigan, the injured drivers and passengers can submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured parties can claim these benefits even if they did not have a Michigan automobile insurance policy.

Furthermore, for this type of accident, the family members of the deceased passenger may be able to make a claim for Survivor Loss Benefits.  This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident.  The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident.  Also, the family members of the deceased passenger  may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused these car accidents. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.  The insurance company for the negligent driver typically pays a settlement in both these types of cases.

Another possible claim for anyone injured by the drunk driver would be a potential Michigan dram shop case against the seller or furnisher of the  alcohol before the accident.

An experienced Michigan car accident lawyer can assist the victims with this type of claim.  Auto accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Royal Oak Bicycle Plan | Michigan Bicycle Accident Lawyers

I recently read a story about Royal Oak’s bicycle plan.  The city council has appointed a task force to develop a comprehensive plan for bicycle, pedestrian, and other non-motorized traffic in the city.  The plan is aimed at reducing the number of bicycle-car accidents after a recent fatal hit and run bicycle accident .  The city also lead Oakland County in the number of bicycle accidents in 2007.

I applaud the city’s efforts to reduce the number of accidents.  Encouraging safety and use of reasonable care is one of the primary goals of the legal system.  Lawsuits hold people accountable for injuries that they cause, with the goal that such lawsuits will make everyone more careful in the future.  In addition, encouraging biking and walking makes everyone healthier.

If you or someone you know is injured in bicycle-car accident, the scale of injuries and the costs of treatment can be enormous.  An experienced lawyer can help you get compensation for these injuries.

Royal Oak Car Accident Kills Pedestrian

A Royal Oak car accident has resulted in the death of a 91-year old pedestrian.  Charlotte Hartman was struck by a car driven by a Battle Creek man as he turned from Main Street onto 11 Mile Road on November 5, 2008.  Ms. Hartman was brought to Beaumont Hospital, where she died a short time later.

I am very sorry this accident happened.  I want to extend my sympathies to the Hartman family.

In Michigan, the No Fault Law provides some comfort for the family in accidents like this.  When someone is killed in a car accident, their family can submit a survivor loss claim to their No Fault insurance company.  Survivor loss benefits provide the family with a portion of the funeral costs, payment for loss household replacement services, and a payment for loss of financial support.  This claim would require a copy of the death certificate and other documentation.  In addition, the family is able to sue the negligent driver who caused Charlotte Hartman’s death.  A lawyer could assist them in submitting their No Fault claim and in evaluating their lawsuit.
