St. Clair County Garbage Truck Accident

A 33-year-old Port Huron man was involved in a St. Clair County Garbage Truck Accident on July 16th. According to police, the man, a Richfield Management employee, was allegedly run over by a garbage truck while he was working.

Police believe the truck was stopping and collecting trash on Mill Street in Algonac when the front wheel of the garbage truck ran over the Richfield Management employee. The man’s right leg and right arm were seriously injured. The man was airlifted to University of Michigan Medical Center. He is in stable condition. Police continue to investigate this accident.

I  am very sorry to hear about this tragic accident and wish the injured man the fullest and speediest recovery possible.  I hope that he comes out of this with no permanent harm.

Michigan truck accident victims have a number of legal rights.  As this accident happened while he was working and involved a motor vehicle,  the Richfield Management Employee may be eligible to receive Michigan Workers Compensation benefits and Michigan No-Fault Benefits. These benefits are similar in that they would cover  his medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.

The Richfield Management employee should speak with an experienced Michigan Accident Lawyer to determine which  benefits he is eligible to receive. Accident victims should not speak with an insurance adjuster for the negligent parties before consulting with an attorney.

St. Clair County Car Accident

A St. Clair County car accident has resulted in injuries for one driver.  The accident occurred when the driver hit another car that was attempting to toe a Jeep out of a ditch on Michigan Avenue near the I-69 overpass.  The driver had minor injuries, which were treated at Port Huron Hospital.

This is a very unfortunate accident and I hope that this driver’s injuries are as minor as the article makes them sound.  I realize that often, initial reports understate injuries from car accidents.  At any rate, I hope he or she is able to recover fully.

In an accident like this one, the injured driver is eligible for Michigan No Fault benefits.  No Fault insurance benefits are available regardless of fault.  One important benefit of No Fault insurance is payment for all medical expenses incurred in an accident, including expenses for treatment of injuries that manifest themselves after the initial treatment.  The only limitation is that medical expenses must be for “reasonable and necessary” treatment of injuries caused by the accident.  As long as a medical expense is reasonable and necessary and for an injury that was caused by the accident, Michigan No Fault insurance should cover it.  Other benefits are also available, but often, medical expenses are the largest and most pressing expenses.

Iosco County Motorcycle Accident Kills Port Huron Man

A Port Huron man was killed in a fatal Iosco County motorcycle accident.  Michael Randolph, 35, of Port Huron was killed when he lost control of his motorcycle while rounding a curve on Putnam Road near Webb Road.  No other vehicles were involved but police believe alcohol may have been a factor.

This is very unfortunate and my sympathies are with this man’s family.

My law firm regularly represents people who have been injured in motorcycle accidents and their families.  The first step in advising a client is determining what types of claims they may have.  I would always inquire into what kind of insurance coverage a motorcyclist has, because the family may have an insurance claims based on a policy in force at the time of the accident.  In addition, if alcohol was in fact a cause of the accident, it would be important to determine if any bar or restaurant served the motorcyclist alcohol since the family may have claim against that place.  This kind of claim is called a dram shop claim.
