I am very sorry to hear about this tragic Michigan car accident. My condolences and sincerest wishes to the family of the passenger for their loss.

Michigan car accident victims have a number of legal rights.  For this type of Michigan auto accident, the family members may be able to make a claim for Survivor Loss Benefits under the Michigan No-Fault Laws.  This can include payment of funeral expenses, lost wages, and loss of other services.

Furthermore, the family members may have a claim for Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this car accident. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.  The insurance company for the negligent driver typically pays a settlement for this type of case.

Michigan auto accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Michigan car accident victims have a number of legal rights.  For this type of accident, the injured passenger can  submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured passenger can claim these benefits even if they did not have an automobile insurance policy.

In addition, the injury victim may be able to file a lawsuit against the persons driving the car.  The insurance company for the driver must still cover any injuries. In this lawsuit, they can claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Pittsfield Township Car Accident

A Pittsfield Township car accident resulted in serious injuries for a passenger after he was ejected from the car on October 21, 2008.  The accident occurred along Munger Road near Michigan Avenue.  The man was transported by Huron Valley Ambulance to St. Joseph Mercy Hospital.  The crash remains under investigation, but alcohol is suspected as a factor.

This sounds like it was a very serious accident, and I am very sorry it occurred.  I hope that the man injured is able to experience a complete recovery.

My law firm represents people who have been injured in car accidents similar to this one.  An important first step after a car accident is to determine all the claims this man can possibly pursue to get compensation for his injuries.  This man is eligible for Michigan No Fault benefits which will cover his medical expenses and a portion of lost wages if he has to miss work because of the accident.  He may also be eligible for other No Fault benefits depending on the severity of his injuries.

If his injuries are very severe, he may also be able to sue the driver who was at fault in the accident for his personal injuries and collect damages in excess of those allowed under the Michigan No Fault Act.  Even if the at fault driver was the person driving the car he was a passenger in, he may still be able to sue under Michigan’s guest statute.

Finally, if alcohol was in fact involved, this man may be able to sue the bar or restaurant that served his driver alcohol.  This is called a dram shop claim.

This man or a member of his family should contact an experienced Michigan car accident to ensure his No Fault claim is properly submitted and to begin evaluating whether he has claims against the at fault driver and a bar.
