Ogemaw County Car Accident

Two Drivers and two children were seriously injured in an Ogemaw County Car Accident at the intersection of Rose City and Fairview Roads in Klacking Township on May 30th. According to the Michigan State Police, one vehicle, driven by Joyce Kruger of Mio, was allegedly travelling southbound on Fairview road and another vehicle with the two children, driven by their mother Po Hwa Souva, was travelling eastbound on Rose City road when the two vehicles collided in the Michigan car accident.

Both drivers and children were transported to Saginaw St. Mary’s Hospital with serious injuries. The car accident is still under investigation and the State Police have called in an car accident reconstruction expert to help with the investigation. The victim’s conditions are unknown at this time.

I am very sorry to hear about his tragic car accident and wish all the injured parties a speedy and full recovery.

Michigan car accident victims have a number of legal rights.  For this type of auto accident, the injured passengers and drivers can  submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured passengers and drivers can claim these benefits even if they did not have an automobile insurance policy.

In addition, the injury victims may be able to file a lawsuit against the persons determined to be at fault in the auto accident.  Even though these are the children of one of the drivers, the insurance company for the drivers must still cover any injuries. In this lawsuit, they can claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Ogemaw County Truck Accident | Ann Arbor Truck Accident Lawyers

A young boy was killed and several members of his family injured in an Ogemaw County truck accident.  The accident occurred near Rose City on November 24, 2008 when icy roads on M-33 caused the father of the family to lose control of his vehicle and slide into the next lane.  A semi truck hit the vehicle broadside.  The 10-year old boy was killed, his 6-year old sister and their father are in serious condition, and the mother and a third child were treated for less severe injuries.  The family was returning from a church retreat to their home in Ann Arbor.

This accident is a true tragedy, especially because of what has happened to the family’s children.  I want to extend my sympathies to this family.

In an accident like this, the family should speak with a lawyer as soon as possible.  That way they can get help submitting claims to their No Fault insurance company to get the father and daughter’s medical expenses paid, to get survivor loss benefits for the boy, and to get lost wages to maintain their standard of living.  The quicker they submit these claims, the sooner they will be able to get their high medical bills, funeral, and other expenses paid for.

In addition, a lawyer could investigate this accident and help determine who was at fault for the accident.  Although the family will be able to collect No Fault benefits regardless of fault, they may be able to sue the truck driver or his employer for additional damages since their son died and it is likely that the father and daughter are seriously hurt.  This lawsuit would be one for negligence so they could only bring it if it is determined they were not at fault in the accident.

Ogemaw County Car Accident

An Ogemaw County car accident has resulted in the death of a woman.  Shannon Bentley, 25, of Sault Ste. Marie was tragically killed after experiencing engine trouble on I-75.  Another driver struck her car, which had only been partially pulled over onto the shoulder.  This driver, a 60-year old Tecumseh man, was taken to St. Mary’s of Michigan Hospital in Saginaw and underwent surgery on Monday.  He remains in critical condition.

This is a very tragic accident.  My sympathies go out to the Bentley family and their friends.  I also hope that the other driver is able to experience a full recovery.

My law firm represents people involved in car accidents.  Quite often, people are uncertain of their rights following a car accident like this one.  Both drivers have claims for No Fault insurance, which will pay for all of the male driver’s medical expenses and any lost wages as well as for a portion of the funeral expenses for Shannon Bentley.  In addition, the driver who is determined to be free of fault may have a legal claim against the at-fault driver depending on the severity of his or her injuries.  Since Ms. Bentley died, her injuries are clearly sufficiently severe for her to have a claim, but it would depend on how severe the other driver was injured to determine if he would have a claim.
