Michigan No-Fault Insurance Lawyers – What does “No-Fault” mean?

Most of you have heard the phrase “No-Fault” but do not know exactly what it means or how it affects you if you are involved in a car accident. You are not alone.

Basically, it means that you can get insurance benefits regardless of whether you or someone else was at fault in the accident. That’s right, you are entitled to insurance benefits even if you were at fault in the accident in the State of Michigan.

Generally, when you are involved in a car accident in Michigan, there are three types of insurance claims. They are classified as:

  1. Car repairs and damages (Payment for repairs to your vehicle)
  2. Bodily injury claims (Payment for your personal injuries)
  3. No-Fault insurance benefits (Payment for wage loss, medical expenses, etc…)

Because Michigan is a no-fault state, you are required to make claims against your own insurance company for car repairs and no-fault benefits. Michigan law also allows you to make a claim against the driver and owner of the car who was at fault in the accident if you suffered personal injuries, such as for pain and suffering and any visible scars or disfigurement. These are called bodily injury claims.

Fatal Upper Peninsula Motorcycle Accident

I read a tragic story in the paper today about a Fatal Upper Peninsula Motorcycle Accident near Mesick, Michigan  yesterday. According to the Wexford County Sheriff’s Department, an Arlington couple were travelling on a motorcycle on M-115, near the intersection of M-37, when a van pulling a camper allegedly turned in front of them. The bikers’ motorcycle struck the van causing serious and life threatening injuries to the bikers. The bikers were transported to Munson Medical Center where they subsequently died. Police are still investigating the accident.

I  am very sorry to hear that this tragic motorcycle accident happened. My condolences go out to the family and friends of the bikers.

Sterling Heights Motorcycle Accident

I read in the paper today about a tragic Sterling Heights Motorcycle Accident that occurred in Sterling Heights last week. According to police, two bikers were seriously injured on M-59 when their bike was allegedly struck from behind by a drunk driver that failed to stop for a traffic signal. The motorcycle was stopped at the light when it was struck and pushed into a vehicle in front of them.

Both bikers were taken to the hospital with serious injuries. Police continue to investigate this accident and are currently looking for anyone who witnessed what happened.

I  am very sorry to hear about this accident and wish the biker and his passenger a speedy and complete recovery.

South Haven Motorcycle Accident Injures Woman

I read a story about a tragic South Haven motorcycle accident that caused serious injuries to a motorcycle passenger.  The Sherrif’s Department reported that Ariel Anderson of Kalamazoo suffered serious internal injuries after leaving the South Haven fireworks display the other night.  The driver of her motorcycle apparently tried to pass other cars and collided with a driver who was turning into a private driveway.

I hope that Ms. Anderson has a speedy and successful recovery.

Under Michigan law, Ms. Anderson has several possible legal remedies for her injuries.  This will be helpful because she will most likely incur significant medical expenses and may be disabled from employment.  Because she was a passenger on the bike and had contact with another motor vehicle, she is entitled to Michigan No-Fault Insurance benefits which pay for medical expenses, lost wages, household services, and other expenses.

She may also be able to file a claim for her personal injuries against anyone who was negligent in causing her injuries.  This would include the driver of the motorcycle and even if they are friends, this should not interfere with the claim.  Typically, the bikers insurance company would pay a settlement for this type of accident.
