Our Michigan car accident lawyers are reporting a story in the news about a Kent City auto accident that took place on M-37 and Peach Ridge Avenue.  The accident took place on Saturday, November 27th, in the evening hours.  According to police, a vehicle missed a stop sign, driving into the path of another vehicle and striking their car. Both drivers were taken to the hospital and suffer serious injuries. There was a passenger in the vehicle that missed the stop sign. That passenger was ejected from the vehicle due to the impact of the accident and died at the scene of the car accident.

I am very sorry to hear about this tragic accident.  My condolences go out to the family of the deceased victim. I hope that both injured victims have a fast recovery without any permanent damages. (more…)

Fatal Upper Peninsula Motorcycle Accident

I read a tragic story in the paper today about a Fatal Upper Peninsula Motorcycle Accident near Mesick, Michigan  yesterday. According to the Wexford County Sheriff’s Department, an Arlington couple were travelling on a motorcycle on M-115, near the intersection of M-37, when a van pulling a camper allegedly turned in front of them. The bikers’ motorcycle struck the van causing serious and life threatening injuries to the bikers. The bikers were transported to Munson Medical Center where they subsequently died. Police are still investigating the accident.

I  am very sorry to hear that this tragic motorcycle accident happened. My condolences go out to the family and friends of the bikers.

Our Michigan car accident lawyers advise accident victims of their legal rights.  For this type of auto accident in Michigan, the family members of the deceased victims may be able to make a claim for Survivor Loss Benefits.  This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident.  The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident.

Also, the family members of the deceased victims may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused these car accidents. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Sparta Car Accident

A Sparta car accident has left three people in the hospital with injuries.  The accident occurred on December 18, 2008 on M-37 when a car lost control and hit an oncoming vehicle.  Two people were seriously injured and a third was treated for less severe injuries.

I am very sad this accident occurred.  I hope that the three accident victims are able to fully recover from their injuries.

Michigan No Fault benefits will pay for these people’s hospital bills regardless of who is at fault in the accident.  This is because No Fault benefits are available without regard to who caused the accident.  No Fault benefits will cover medical expenses, a portion of lost wages, if any, and possibly other benefits depending on the severity of the injuries.

Based on the news reports, it is impossible to tell which, if any, of the drivers can file a lawsuit.  Under Michigan law, an accident victim who is very seriously injured can sue a driver who has been negligent.  Whether the victim’s injuries are severe enough and whether a driver has been negligent are complicated questions of law and fact.  That is why it is very important to hire a good lawyer who knows the law and who knows how to fight for you.
