Fatal Holland Car Accident

There was a story in the paper about a woman who died in a fatal Holland car accident on November 29 in Ottawa County. According to police, a car, driven by a nursing home activities director, collided with a Lincoln Navigator at the intersection of Riley Street and Country View Lane. The female driver was rushed to the hospital for treatment of her serious injuries, where she died five days later. Police are still investigating this accident.

I am very sorry to hear about this tragic accident and offer the family of the deceased woman my most sincere condolences and best wishes.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the family members of the deceased woman may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injury victims may be able to file a lawsuit against the persons determined to be at fault in auto accident. The insurance company for the driver must still cover any injuries. In this lawsuit, the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased woman may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident. At the very least, the surviving family members should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Holland Bicycle-Car Accident

A bicyclist was seriously injured in Holland Bicycle-Car Accident when he was struck by a car on 9th Street. According to witnesses, the bicyclist was allegedly struck by a car leaving the post office and dragged underneath onto 9th Street. The bicyclist was transported to the hospital where he is in critical condition.

I am very sorry hear that this accident happened. It is my hope and best wishes to the bicyclist for a speedy and full recovery from this accident.

Michigan car accident victims have a number of legal rights.  For this type of accident, the injured bicyclist can  submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover his medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  The injured bicyclist can claim these benefits even if they did not have an automobile insurance policy.

In addition, the injury victim may be able to file a lawsuit against the persons driving the car.  The insurance company for the driver must still cover any injuries. In this lawsuit, he can claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Holland Car Accident Lawyers

A Holland Township car accident has injured three women.  The accident occurred on December 22, 2008 on James Street near 142nd Avenue.  Cori Lynn Price, 21, of Holland, lost control of her vehicle, which slid across the centerline and struck a car driven by Nancy Moore, also of Holland.  Cori Price and her mother Judy Lynn Price were pinned inside the car and had to be extricated by the Holland Township Fire Department before being taken to Spectrum Butterworth Hospital in Grand Rapids with critical injuries.  Nancy Moore was taken to Holland Hospital with serious injuries.

I am very sorry this accident occurred.  I hope all three victims pull through and have a full recovery.

All of the women injured in this accident are eligible to receive Michigan No Fault benefits.  Their insurance companies are obligated to pay all reasonable and necessary medical expenses, including hospital bills and follow-up treatment.  Their insurance companies are also obligated to pay a portion of lost wages, up to $20 per day for household replacement services, and reasonable rates for attendant care, among other benefits.

If a driver or passenger has been severely injured by a negligent driver, that person can sue the at-fault driver for their injuries.  Based on news report, it appears Cori Price was at fault, which means Judy Price and Nancy Moore may be able to sue her.  Both of them should discuss this with a lawyer so they can decide, first, if their injuries are severe enough that they have the option of filing a lawsuit, and, second, if they do in fact want to sue.  Judy Price can sue her own daughter, and she should strongly consider it if her injuries are very bad, since this lawsuit will be paid for and defended by their insurance company.

Holland Bus Accident

A Holland bus accident has seriously injured a Hope College student.  Ryan Sheets, 22, was driving at the intersection of 22nd and Homestead when a Max Transit bus failed to yield the right of way.  The bus struck Ryan Sheets’ vehicle which hit a parked car and rolled over.  Ryan Sheet was transported to Holland Community Hospital before being airlifted to the University of Michigan Hospital.

This is a very tragic accident, especially because the victim is so young.  I hope that he is able to experience a full recovery.

Although this is probably the last thing on his family’s minds, I would encourage them to file a claim for Michigan No Fault insurance as soon as they can.  These benefits will pay for Ryan Sheets’ medical expenses and take care of a major economic cost of this accident.  Because their insurance company will take time to process their claim before paying the medical bills, it is in the family’s best interest to file quickly.  This will give them more free time to assist in Ryan’s recovery.  They should submit claims for other benefits such as wage loss, attendant care, and household replacement services at the same time to get those claims processed as well.  An experience Michigan car accident lawyer could assist them in filing the claim.

Ryan Sheets likely has a claim against the driver of the Max Transit bus and the Max Transit Authority for negligence.  The best thing to do to pursue this claim is to consult with an experienced Michigan car accident lawyer.

Holland Township Bike Accident

A Holland Township bicycle accident has tragically killed an 11-year old boy.  Gievanni Grimaldo was riding his bike to school when he was struck by two cars on Riley Street near Westland Street.  Police are still investigating the accident, but their initial investigations have revealed neither driver was speeding and Gievanni was wearing dark clothing.

This is a terrible tragedy and my sympathies extend to the Grimaldo family and this boy’s friends.  Anytime someone’s life is cut short by a car accident it is painful, but it is especially bad when the victim is so young.

My law firm represents people injured in car accidents and, too often, we represent people whose children are killed in car accidents.  Many times, people think that children are not eligible for No Fault insurance benefits because they are too young to drive and do not have their own policies.  This is completely false.  In fact, as long as a child who has been injured or killed in a car accident lives with someone who has a No Fault policy, they are covered by that policy exactly as if they were the policyholder.  In an accident like this one, that means the Grimaldo family could get a No Fault survivor loss benefit which would pay for a portion of the funeral costs and possibly other benefits as well.  In addition, the Grimaldo family likely has a wrongful death claim against one or both of the drivers who hit Gievanni.  The best thing they could do is contact a lawyer to assist them in handling their claims.
