Fatal Genoa Township Head-on Collision Accident

There was a tragic story in the news today about a woman seriously injured in a fatal Genoa Township head-on collision accident on January 20th in Livingston County. According to the Livingston County Sheriff, a 27-year-old Howell man was passing vehicles at a high rate of speed on Grand River, near Chilson, when he swerved into oncoming traffic and collided head-on with a large SUV, driven by a 48-year-old Brighton woman. The woman suffered serious injuries to her knees and chest and was taken to a local hospital for treatment. The Howell man did not survive the crash. Police said they found an open whiskey bottle and prescription drugs but were not sure if they were a factor in the crash. The investigation is ongoing.

I am very sorry to hear about this accident and hope that the Brighton woman recovers from this accident without any permanent injuries or deficits. My condolences to the family of the Howell man on  their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the injured woman can submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover her medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident. The injured party can claim these benefits even if she did not have a Michigan automobile insurance policy.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victim can claim damages and compensation for the injuries suffered in the accident. At the very least, she should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Genoa Township Car Accident

A Genoa Township car accident resulted in the death of a Brighton teenager.  Steven Dennis Baker II, 17, of Brighton was pronounced dead on the scene of the accident, which occurred on Dorr Road south of Grand River on October 24, 2008 when Steven Baker’s vehicle crashed into a vehicle driven by Lance Owen Newberry, 54, of Howell.  Lance Newberry was airlifted to University of Michigan Hospital where he was originally listed in critical condition.  He has since been upgraded to good condition.  It is unclear how the accident occurred or who was at fault.

This is a very tragic accident, especially because Steven Baker is so young.  It is also very unfortunate that Lance Newberry was injured.  My sympathies extend to both of their families, and I hope Lance Newberry is able to recover fully from his injuries.

My law firm represents people injured or killed in car accidents, and I am very familiar with accidents like this one.  Both drivers have a claim for Michigan No Fault benefits regardless of who was at fault in the accident.  No Fault insurance benefits will cover all medical expenses incurred and will pay a portion of wages for three years as well as other expenses depending on the severity of the injuries.  If the Baker family submits a claim for No Fault benefits, they can make a survivor loss claim which will provide payment for a portion of the funeral costs.

In addition, the driver who was free of fault may have a lawsuit against the at-fault driver depending on the severity of injuries.  If Steven Baker is determined to be free of fault, his family can certainly pursue a lawsuit since he died in the accident.  If Lance Newberry is determined to be free of fault, the best thing he could do is speak with a lawyer about the accident and his injuries to determine if he does or does not have a valid lawsuit.
