Fatal Hit & Run Accident in Monroe County

I heard a tragic story on the radio today about a Fatal Hit & Run Accident in Monroe County yesterday. According to the Monroe County Sheriff’s Department, Diane Norris was allegedly hit and killed as she walked along North Dixie Highway in Frenchtown Township. The police investigation found enough evidence that the vehicle that hit Ms. Norris was a Pontiac Grand Am. The police are still investigating and ask anyone with information contact them so they can locate the driver responsible for this tragic death.

I am very sorry to hear about this tragic car accident and wish my most heart-felt condolences to the family of the Diane Norris for their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights.  For this type of auto accident in Michigan, the family members of the deceased victim may be able to make a claim for Survivor Loss Benefits.  This can include payment of funeral expenses, lost wages, and loss of other services.

If the driver’s identity is not discovered, the woman’s family still has rights under the law. They may be able to file an uninsured motorists claim against their own insurance policy or another insurance policy to receive the Survivor Loss Benefits.

In addition, the injury victims may be able to file a lawsuit against the persons determined to be at fault in the auto accident.  The insurance company for the driver must still cover any injuries. In this lawsuit, any injured parties and the family of the deceased victims can claim damages and compensation for injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased victim may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Frenchtown Township Motorcyle Accident Kills Newport Motorcyclist

A Frenchtown Township motorcycle accident killed a motorcycle driver last week.  Adam Servey, 25, of Newport, Michigan, was killed Friday when his motorcycle collided with a tractor trailer semi on Telegraph Road in Frenchtown Township.  The accident is still under investigation, but speed appears to have been a factor in causing the accident.

My sympathies go out to the friends and family of Adam Servey.  Losing a loved one is never easy, but this must be especially hard since he was so young when the accident happened.

Even though there has been no determination of who is at fault, the driver may be entitled to No Fault benefits, which include payment of any hospital bills and medical expenses, as well as a portion of the funeral expenses.

If it is determined that the driver of the semi was at fault, the family of the motorcyclist will have a claim against him for his negligence.  This is a wrongful death claim that would include damages for loss of financial support, payable to anyone who depended on his income for support.  A wrongful death claim would also include damages for loss of companionship, payable to his family.  Damages for wrongful death also include a portion of the funeral expenses.

Even if it is determined that the motorcyclist was at fault, his family is still entitled to No Fault benefits
