Monroe County Wonder Bread Truck Accident Fatality
A 70 year old man was killed in a Monroe County Wonder Bread Truck Accident on May 14th that occurred on I-275 in Huron Township. According to State Police, the accident occurred during a down-pour when a Wonder Bread truck driver rear-ended a 2007 Pontiac exiting the expressway, breaking the vehicles rear lights, and pushing it into oncoming traffic on I-275.
A Ford Explorer, driven by a 75 year old Hazel Park man, had to swerve to avoid the Pontiac and, due to the hazardous road conditions from the rain, rolled his vehicle killing him and seriously injuring his 42 year old son, the passenger. The driver of the Pontiac and her son were injured as well. The Pontiac driver and two passengers were taken to a local hospital to be treated for their serious injuries.
I am very sorry hear that this accident happened and I hope that the survivors are able to recover completely from their injuries. My condolences to the family of the Hazel Park man for their loss.
Michigan car accident victims have a number of legal rights. For this type of accident, the injured passengers and drivers should submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident. Accident victims in Michigan can receive these benefits regardless of who was at fault in the accident. The injured passengers can claim these benefits even if they did not have an automobile insurance policy.
Additionally, Family members may also may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services. Furthermore, family members of the Hazel Park man may have a claim for wrongful death against Wonder Bread for the truck driver’s negligence and against Ford Motor Company for a design flaw in that the Explorer rolled. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.
In addition, the injury victims may be able to file a lawsuit against the person or persons driving the cars and the driver and the owner of the Wonder Bread truck. In this lawsuit, they could claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case. An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.
