Vienna Township Roll Over Car Accident

A Vienna Township roll over car accident has injured an Onsted woman.  The accident occurred on December 24, 2008 when a woman driving on I-75 hydroplaned on a pool of standing water near Dodge Road.  The car spun and rolled over, trapping the woman inside.  Her husband and children were able to escape the car.  She was treated for injuries, although it is not clear how seriously she was hurt.

I am very sorry this accident occurred.  I hope this woman is able to fully recover.  Although it may not seem like it, she is actually very lucky.  She and her whole family could easily have been severely injured or even killed.

As a lawyer who represents victims of car accidents, I know many people believe that their car insurance will only cover accidents in which they are not at fault or in which there are two or more cars.  Neither of these are true.  In fact, Michigan No Fault insurance benefits are available regardless of fault and regardless of how many vehicles were involved in the accident.

This woman should submit a claim to her No Fault insurance company.  No Fault insurance will pay for her medical expenses and cover a portion of her lost wages if she has to miss work.  Other benefits will provide payments for household chores if she is temporarily unable to perform them as she normally would.  Other benefits are also available for the very seriously injured.  A lawyer could help walk her or her family through these benefits or help them submit the claim.

Vienna Township Car Accident

A Vienna Township car accident has resulted in the deaths of two young men.  Johnny Quackenbush, 28, and Brian Schmiter, 27, were killed on November 21, 2008 when Johnny Quackenbush lost control of his vehicle on Francis Road near Elms Road and hit a tree at about 90 miles per hour.  Both men were thrown from the car, which split in half on impact.  Police estimate the crash occurred at about 4:00 am, but it was not discovered until morning.  Police believe alcohol was involved, but they are awaiting results from toxicology tests.

I am sorry this accident occurred.  I want to extend my sympathies to the families of these men.

Both families can file a survivor loss claim through their Michigan No Fault insurance company.  Survivor loss benefits will cover a portion of the funeral costs and may provide other benefits.  For example, if either of these men had a wife or dependents, they could receive payments for loss of financial support.  If either of them performed chores around the house, they could collect household replacement services at a rate of $20 per day for up to three years.

Brian Schmiter’s estate could also sue Johnny Quackenbush’s estate for wrongful death.  This lawsuit could seek damages beyond what could be collected from No Fault insurance.  If alcohol was involved, the Schmiter estate might also be able to sue a bar or restaurant that served alcohol to Johnny Quackenbush.  This type of suit is known as a dram shop claim.

Genesee County Car Accident | Flint Car Accident Lawyers

A Genesee County car accident has left a teenager dead and another woman with serious injuries.  An 18-year old Flushing man was stopped at a traffic light at Corunna and Elms on November 1, 2008 when he was violently rear-ended by a 48-year old woman from Flint.  The impact of the crash was so strong that pushed the front car over 75 yards from the intersection.  The 18-year old was killed in the crash while the 48-year old remains in serious condition.  Police are still investigating the causes of the accident, including whether alcohol was involved.

This is a real tragedy especially because the victim is so young.  I feel terrible for this man’s family.  I hope everyone will slow down and pay better attention to the road.  I also hope that the woman has a complete recovery.

In an accident like this, both the woman and the man’s family can submit claims for Michigan No Fault benefits while the police investigation is still on-going.  Their No Fault benefits will cover medical expenses, lost wages, and other services.  In addition, a Michigan No Fault survivor loss will help the man’s family in paying for the funeral.  Finally, the driver who is eventually determined to be free of fault may be able to sue the negligent driver, but this will depend on the exact circumstances and injuries involved in the accident.  The best thing both the woman and the man’s family could do is to speak with an experienced Michigan car accident attorney about their accident.
