Fatal Motorcycle Crash

I read a tragic story about a fatal motorcycle accident that took the life of a 48 year old woman, Helen Reeves.  She was riding her bike when a motorist crossed the center lane of the roadway and struck her, killing her instantly.  The driver appears to have been intoxicated and was arrested at the scene of the accident and taken to jail.

This is a tragedy that should have never happened.  My thoughts go out to her family and friends.  I only hope that the court system lays a heavy hand on the driver if the allegations prove to be true.

In my practice, I see instances like this way too often in my motorcycle accident cases.  Although many in the public believe that bikers are at fault in most accidents, I have found the opposite to be true.  It is most often negligent motorists who ignore the rights of bikers and other drivers and cause these catastrophic accidents.  With Summer now here and bikers in mid-season form, I can only hope that drivers become more responsible so accidents like this one do not happen again.

Shelby Township Wrongful Death Case

Attorney Robert J. Lantzy from our law firm recently filed a wongful death lawsuit in the Macomb County Circuit Court on behalf of the estate of Vincent Megna.  Mr. Megna was killed in a September 2005 auto accident at 23 Mile Road and Van Dyke.  The suit was filed against the driver and owner of the other vehicle involved in the accident.  A news story about the accident and the lawsuit was recently publised by the Macomb Daily.  The suit seeks damages for the surviving family as permitted under the MIchigan Wrongful Death Statute.

Passenger Injuries: Michigan Car Accidents

Passengers injured in MIchigan car accidents have several possible claims for their injuries.  First and foremost, they are always entitled to Michigan No-Fault Insurance Benefits even if they did not have their own auto insurance policy.  These benefits entitle the injured passenger to payment of medical expenses for their lifetime, wage loss benefits, replacement care benefits, and other great benefits.  To determine which insurance company must pay these benefits and what you need to do to file your claim, just give me a call and I’ll help you get your claim started.

The injured passenger can also sue the negligent driver for his or her personal injuries.  This includes claims for pain and suffering, disability, and scars or disfigurement.  Interestingly though, the passenger can sue the driver of the car that he or she was in if that driver was the one who was negligent and caused the accident.  This is true even if you were riding in a car driven by a family member or friend.  Your claim would be against their auto insurance company, just as if you were suing the driver of another car who was negligent and caused your injuries.
