Fatal Hamilton Township Car Accident

There was a story in the paper today about a man killed and a woman seriously injured in a fatal Hamilton Township car accident on December 10 in Clare County. According to the Clare County Sheriff, a 63-year old Harrison man, in a Ford Focus, was traveling east on M-61 near Dodge Lake Road and allegedly lost control of his vehicle due to slush on the road, crossed the center line and hit an oncoming Pontiac Aztec, driven by a 43-year-old Harrison woman. The man was pronounced dead at the scene and the woman was was taken to a local hospital to be treated for her serious injuries. Police are still investigating this accident.

I am very sorry to hear about this tragic accident and hope the injured woman has a complete and full recovery from their serious injuries. My condolences go out to the family of the Harrison man for their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the injured woman can submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover her medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident. The injured parties can claim these benefits even if they did not have a Michigan automobile insurance policy.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident. At the very least, they should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Clare County Car Accident

A Clare County car accident resulted in the death of an 85-year old man.  The accident occurred on November 26, 2008 when the man was riding his tractor to plow his driveway.  Norman Mosey was hit by a minivan as he rode his tractor onto Temple Road near Coolidge Avenue in Hayes Township.  The driver of the minivan stated she was unable to stop due to slippery road conditions.

This is a truly unfortunate accident.  I want to extend my sympathies to the family of Norman Mosey.

Norman Mosey’s family should submit a claim for Michigan No Fault insurance.  No Fault benefits are available because his accident involved a motor vehicle.  A No Fault survivor loss claim will provide his family with economic support so they can better handle this unexpected loss.  Survivor loss benefits include a payment for a portion of the funeral cost as well as payments for loss of household services and loss of financial support.

In addition, Norman Mosey’s estate may want to sue the driver of the minivan.  Since this lawsuit will be based in negligence, the outcome will depend on which party was at fault and whether either party failed to use reasonable care.  This will depend on all the facts and circumstances of the accident.  The two things the family should do is obtain a copy of the police traffic accident report and speak with a lawyer who specializes in handling fatal car accident cases.
