I read a story about a tragic South Haven motorcycle accident that caused serious injuries to a motorcycle passenger.  The Sherrif’s Department reported that Ariel Anderson of Kalamazoo suffered serious internal injuries after leaving the South Haven fireworks display the other night.  The driver of her motorcycle apparently tried to pass other cars and collided with a driver who was turning into a private driveway.

I hope that Ms. Anderson has a speedy and successful recovery.

Under Michigan law, Ms. Anderson has several possible legal remedies for her injuries.  This will be helpful because she will most likely incur significant medical expenses and may be disabled from employment.  Because she was a passenger on the bike and had contact with another motor vehicle, she is entitled to Michigan No-Fault Insurance benefits which pay for medical expenses, lost wages, household services, and other expenses.

She may also be able to file a claim for her personal injuries against anyone who was negligent in causing her injuries.  This would include the driver of the motorcycle and even if they are friends, this should not interfere with the claim.  Typically, the bikers insurance company would pay a settlement for this type of accident.

I read a tragic story about a Michigan man, Robert Jackson Sr. of Hazel Park, who suffered fatal injuries recently in a Utah car accident. His son, the driver of his vehicle, suffered serious injuries. Police believe that the driver of a pickup truck cut into their lane of traffic and caused the accident. It is still being investigated.

My thoughts and condolences go out to the family. I hope that the son has a speedy and complete recovery for his injuries. It is hard to imagine what the last week has been like for the family.

Under the Michigan No-Fault Insurance system, a person who suffers injuries arising out of the use of a motor vehicle can make a claim for Michigan No-Fault Insurance benefits.  These include payment of medical bills, lost wages, attendant care services, household services, and other benefits.  It is not always clear which auto no-fault insurance is responsible for paying benefits.  To make this determination, the Michigan No-Fault Statute has what is called the “Order of Priority“ which lists which insurance company is responsible for paying benefits in every type of situation.

The Order of Priority is very important because injured persons are required to submit reasonable proof of their claims to the proper insurance company within certain time frame limits.  If a deadline is missed, the claim may be lost forever.  The determination as to which insurance company is responsible is often complicated and depends on a number of factors.  In general, a person injured in a motor vehicle accident would first make claim against his or her own no-fault insurance company in every situation, whether a driver, passenger, or pedestrian at the time of the accident.  This is the most basic scenario but matters become more confusing.
