A Monroe County car accident has resulted in the death of a Manchester woman.  The accident occurred on December 30, 2008 when Carl Pierson was attempting to turn left from M-50 onto Cabela Blvd.  His car was hit by a minivan, which then struck another vehicle, injuring Elizabeth Tennant.  Carl Pierson’s passenger Brenda Pierson died following the accident.  Carl Pierson and Elizabeth Tennant were hospitalized with serious injuries.  Neither the driver nor passengers of the minivan were injured.

 

I want to expect my sympathies to the family of Brenda Pierson.  I also hope that Carl Pierson and Elizabeth Tennant are able to recover from their injuries.

 

Both Carl Pierson and Elizabeth Tennant should file a claim for Michigan No Fault insurance benefits.  No Fault insurance will pay for their medical expenses and any lost wages if they have to miss work because of the accident.  Their insurance companies will also pay for household services, attendant care, and other benefits if their injuries are severe.

 

If their injuries are very severe, they could sue the driver who caused the accident.  It is not clear from the news story who was at-fault so they should discuss this with a lawyer.  In addition, Michigan law allows only those seriously injured to file a lawsuit, but they can describe their injuries to the same lawyer, who should be able to make a determination as to whether they can file a lawsuit.

 

Brenda Pierson’s estate can submit a No Fault survivor loss claim, which will help the family handle the costs of her death by providing money for a funeral and by providing payments for loss of household services and loss of financial support.  The estate would also be able to sue the negligent driver who caused her death.
