Fatal Homer Township Drunk Driving Accident

There was a tragic story in the paper today about a boy killed and another one injured in a fatal Homer Township drunk driving accident on December 12 in Calhoun County. According to the Calhoun County Sheriff’s Department, two boys were in a vehicle, allegedly driven by a 30-year-old Litchfield man, on westbound U Drive when the driver allegedly lost control, left the roadway, overturned and hit a tree. One boy died on the scene, the other suffered life threatening serious injuries. He was taken by Medflight to University of Michigan Medical Center. Police suspect that alcohol was factor in this case and are still investigating.

I am very sorry to hear about this tragic accident and hope the injured boy has a complete and full recovery from his serious injuries. My condolences and best wishes go out to the family of the deceased boy for their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the injured boy can submit a claim for Michigan No-Fault insurance benefits. No-Fault benefits will cover his medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident. The injured parties can claim these benefits even if they did not have a Michigan automobile insurance policy.

Also, for this type of auto accident in Michigan, the family members of the deceased boy may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident. At the very least, the surviving family and injured parties should hire the best possible lawyer to look into these possibilities.

Also, the family members of the deceased boy may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident. Another possible claim for anyone injured by the alleged drunk driver would be a potential Michigan dram shop case against the seller or furnisher of the  alcohol before the accident. At the very least, the surviving family members should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim. Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Calhoun County Car Accident

A Calhoun County car accident has left two people injured.  The accident occurred on January 24, 2009 at the intersection of Michigan Avenue and Eden Street in Marshall Township.  Scott Sands, 26, was attempting to turn left onto Eden Street when his vehicle was struck by a vehicle driven by John Malinowski, 37.  Scott Sands’s vehicle was then pushed into a van driven by Dale Sinclair, 74.  Scott Sands was ejected from the vehicle and was taken to Bronson Hospital in Kalamazoo with serious injuries.  Dale Sinclair was transported to Battle Creek Health Systems with minor injuries.  John Malinowski was not injured.

I am very sorry this accident occurred.  I hope that Scott Sands and Dale Sinclair are able to experience full and speedy recoveries.

After the emergency situation of a car accident has subsided, a person who has been injured in a car accident should begin the process of learning about and enforcing his legal rights.  Under Michigan’s No Fault Act, his No Fault car insurance will provide him with payments of all reasonable and necessary medical expenses, a portion of lost wages, household services, and attendant care as well as other benefits.  Both Scott Sands and Dale Sinclair should submit claims for No Fault insurance benefits to their insurance companies promptly.

In addition to a No Fault claim, Michigan law allows accident victims who have been very seriously hurt to file a lawsuit for additional damages.  Whether someone has been hurt severely enough to be allowed to file a lawsuit will vary on a case by case basis, but an experienced Michigan car accident lawyer will be able to evaluate the circumstances of the accident and the details of the victim’s injuries and make an initial determination.  Anyone who is seriously injured in a car accident should contact a lawyer as soon as they can.

Calhoun County Car Accident Lawyers

A fatal Calhoun County car accident resulted in the death of a Vicksburg man on November 16, 2008.  Raymond Hagens, 50, died after his pickup truck hit a tree at 7 ½ Mile Road and K Drive South in Newton Township.  Raymond Hagens was driving at a high rate of speed and went through an intersection before he died.  He was driving on a suspended license.

I want to extend my sympathies to this man’s family.  I am very sorry this accident happened.

Many people do not realize this, but even though this accident was the fault of the decedent, his family can still submit a survivor loss claim to their No Fault insurance company.  Survivor loss benefits include a payment for part of the funeral bill, and payments for loss of support and loss of household services.  To submit a survivor loss claim, it will be necessary to submit a copy of the death certificate, funeral bill, and written proof of the loss of financial support and household services.
