Fatal Detroit Bus Accident

There was a tragic story in the paper today about a woman killed in a fatal Detroit bus accident this morning, March 2nd, on Detroit’s west side. According to witnesses, a deaf Detroit woman, known locally as Ms. Jazz, was crossing Livernois, near Courtland, when she was hit by a City of Detroit bus being test-driven for safety. The deaf woman did not survive the accident. Police are investigating the accident at this time.

I am very sorry to hear about this accident send my most sincere condolences to the family of the deaf Detroit woman for their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the family members of the deceased woman may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injury victim may be able to file a lawsuit against the persons determined to be at fault in auto accident as well as the City of Detroit. The insurance company for the driver must still cover any injuries. In this lawsuit, the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased woman may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident as well as the City of Detroit. At the very least, the surviving family members should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the family of the victim with this type of claim. The family of the accident victim should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Grand Rapids Car Accident Lawyers | Pedestrian Injured in Car Accident

A Grand Rapids car accident seriously injured a pedestrian.  The accident occurred at about 12:30am on December 14, 2008 on South Division near State Bank.  The driver of the car did stop after the accident.  The pedestrian was taken to the hospital with a head injury, but he is expected to survive.  It is unclear if weather conditions played a role in the accident.

I am very sorry this accident occurred.  I hope that the accident victim is able to experience a full recovery.

In an accident like this, the victim’s family should file a claim for Michigan No Fault benefits as soon as possible.  No Fault insurance will pay for all medical expenses, including any reasonable and necessary follow-up treatment.  No Fault insurance will also pay for lost wages, household replacement services, and attendant care benefits, which are payments that can be made to either a health professional or a family member for supervision and care after a car accident victim is released from the hospital.

When an accident involves a head injury, the consequences can be very severe, especially if the injury involves a brain injury.  Anytime one of my clients is seriously injured in a car accident, but especially when they suffer from a brain injury, I encourage them to take advantage of the case management services benefit from their No Fault insurance.  This benefit pays for them to hire a case manager who can help schedule and coordinate medical treatment, transportation, and other aspects of their lives.  Since the insurance company will pay a reasonable rate for a case manager, there is no reason not to use this benefit if the client’s injuries are severe enough that the client will benefit from having a case manager.

A lawyer can help the accident victim or a family member file for the correct benefits and can help them evaluate whether they should sue the driver who caused the car accident.

Kent City School Bus Accident

No injuries were reported in a Kent City school bus accident on December 12, 2008.   The accident happened at Fruitridge Avenue NW and 17 Mile Road early Friday morning.  Although the bus had students on it, none of them were injured and the bus was able to continue its route.

Fortunately no one was injured in this accident.  This is good news since bus accident can be very serious.  The reason bus accidents are often serious is because buses frequently lack many safety features which are standard in cars, such as seat belts and padded seating.

If a child is ever injured in a school bus accident, they may make a claim for No Fault insurance through their parents’ insurance policy.  No Fault insurance will pay for their medical expenses and other benefits.

Bus Accidents | Bay Area Transportation Authority Bus Injuries

I recently read about several people who were injured in Bay Area Transportation Authority (BATA) bus accidents.  Four people have been injured this year due to improper safety belts and harnesses which were either not attached to their wheelchairs or other devices or which were not attached at all.  These injuries particularly affected senior citizens and people with disabilities.  According to the report, BATA officials are responding by inspecting safety equipment and offering additional training to their employees.  Since the injuries that have happened so far this year have been very severe, such as a fractured skull, bruises, and other head injuries, bus passengers should be sure to request all safety measures be used for themselves or people in wheelchairs.

If you or someone you know is injured in an accident like this, they are able to file a claim for Michigan No Fault insurance benefits.   Depending on the severity of their injuries, they may also be able to file a lawsuit seeking additional damages for injuries not compensated by the No Fault Act.
