Calhoun County Car Accident

A Calhoun County car accident has left two people injured.  The accident occurred on January 24, 2009 at the intersection of Michigan Avenue and Eden Street in Marshall Township.  Scott Sands, 26, was attempting to turn left onto Eden Street when his vehicle was struck by a vehicle driven by John Malinowski, 37.  Scott Sands’s vehicle was then pushed into a van driven by Dale Sinclair, 74.  Scott Sands was ejected from the vehicle and was taken to Bronson Hospital in Kalamazoo with serious injuries.  Dale Sinclair was transported to Battle Creek Health Systems with minor injuries.  John Malinowski was not injured.

I am very sorry this accident occurred.  I hope that Scott Sands and Dale Sinclair are able to experience full and speedy recoveries.

Kalamazoo Motorcycle Accident

A Kalamazoo motorcycle accident has left a St. Joseph man with serious injuries.  The motorcyclist was driving north on Kings Highway near 4th Street when he ran over a curb and lost control of the bike.  He was found unconscious near the scene of the accident and was taken to Bronson Hospital where he is in critical condition.  No other vehicles were involved in the crash.  According to reports, alcohol is believed to be a factor, but police are still investigating.

 

This sounds like a very serious and unfortunate accident and my sympathies are with him and his family.  I hope he has a full recovery. 

 

Even though the motorcyclist was not driving a car, he may be entitled to Michigan No Fault benefits.  No Fault benefits include payment of all hospital bills and medical expenses as well as additional benefits depending on the severity of his injuries.  These benefits could include payment for household chores that he can no longer do for himself and for any attendant care, which is supervision of the injured driver that is required as a result of the accident.  Finally, if he has to miss work because of injuries suffered in this car accident, his No Fault insurance may also pay a portion of his lost wages.

 

If alcohol was a factor in the accident, the motorcyclist may also have a claim against a bar or other institution that served him alcohol.  This kind of claim is called a dram shop claim.
