Moped Rider Killed in a Minivan Accident in Coldwater

On October 14th,  2009, a moped rider was killed in a Minivan accident in Coldwater in Branch County. According to the Coldwater Police Department, the moped operator headed north on Michigan Avenue when he was allegedly struck by a Chevrolet Venture minivan attempting to turn onto US-12.

According to witnesses, the moped driver hit the windshield of the minivan and was thrown 30 feet from the moped. The moped rider suffered serious head injuries, internal injuries and broken legs as a result of the accident. He was flown to Borgess Medical Center in Kalamazoo where he died from his injuries.

I  am very sorry to hear that this tragic moped accident happened. My condolences go out to the family and friends of the moped rider.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the family members of the deceased victim may be able to make a claim for Survivor Loss Benefits.  This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the car accident injury victims may also have claims for personal injuries against any driver determined to be at fault in this auto accident. The insurance company for the negligent driver typically pays a settlement for this type of case. In this lawsuit, the injured victims can claim damages and compensation for the injuries suffered in the accident.

Also, the family members of the deceased victim may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused these car accidents. At the very least, the surviving family should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Branch County Car Accident Lawyers

A fatal Branch County car accident has resulted in the tragic death of a teenager.  Michael Lung, 16, was killed in an accident on Deer Park Road near Taggart Road.  The accident occurred when the car he was driving slid sideways, hit a post on the driver’s side, and crashed into a tree.  The only passenger, Shane Lung, Michael’s brother, suffered fractured ribs.  Shane Lung was listed in stable condition at Sturgis Hospital.  According to the Branch County Sheriff’s Department, icy road conditions resulted in several accidents on January 6, 2009.

This accident is very tragic, especially because the victims are so young.  I want to express my sympathies for the Lung family and the Burr Oak school community.  I do hope that Shane Lung is able to experience a full recovery.

In an accident like this one, a family may feel like there is nothing they can do.  This is not true.  The best thing they can do is submit a claim for Michigan No Fault insurance.  A No Fault claim for Shane’s medical expenses will require the insurance company to pay for all reasonable and necessary hospital bills, doctor’s appointments, and rehabilitation.

A No Fault survivor loss claim would provide the family with a payment for a portion of Michael’s funeral costs.  It could also provide payments for loss of household services if Michael ever performed any chores around the house for his family.  A lawyer could help handle both No Fault claims.

Branch County Car Accident

A Branch County car accident has left a Sturgis man with serious injuries.  Jaime Vela was driving on Orland Road at a very high rate of speed when he failed to negotiate a curve.  When police responded, they found the car engulfed in flames and Vela already ejected from the vehicle.  He was taken to Bronson Methodist Hospital in Kalamazoo and is in critical condition.  A 17-year old passenger was also treated for minor injuries.  Two other individuals were reportedly also riding in the car, but they had fled the scene before the police arrived.  The accident remains under investigation.

This is a tragic accident and it sounds horrible.  I hope Jaime Vela and his passenger have a full recovery.

Michigan No Fault insurance benefits are available to help cover the costs of this accident.  Both Mr. Vela and his passenger are eligible to receive No Fault benefits if they or someone they live with have a No Fault insurance policy.  No Fault benefits will cover medical expenses, lost wages, and other expenses depending on the severity of the injury.
