Order of Priority | Michigan No-Fault Insurance Lawyers

Under the Michigan No-Fault Insurance system, a person who suffers injuries arising out of the use of a motor vehicle can make a claim for Michigan No-Fault Insurance benefits.  These include payment of medical bills, lost wages, attendant care services, household services, and other benefits.  It is not always clear which auto no-fault insurance is responsible for paying benefits.  To make this determination, the Michigan No-Fault Statute has what is called the “Order of Priority“ which lists which insurance company is responsible for paying benefits in every type of situation.

The Order of Priority is very important because injured persons are required to submit reasonable proof of their claims to the proper insurance company within certain time frame limits.  If a deadline is missed, the claim may be lost forever.  The determination as to which insurance company is responsible is often complicated and depends on a number of factors.  In general, a person injured in a motor vehicle accident would first make claim against his or her own no-fault insurance company in every situation, whether a driver, passenger, or pedestrian at the time of the accident.  This is the most basic scenario but matters become more confusing.

Michigan Attendant Care Claim Forms Online

Michigan attendant care service benefits, also called nursing service benefits, are an allowable expense under the Michigan No-Fault law.  These benefits provide payment for essentially take care of the auto accident injury victim during periods of recovery and rehabilitation.  The services include supervision, assistance with medications, bathing, grooming, feeding, and other important needs.  These services can be up to twenty-four hours per day.

In order to receive these benefits, they must be deemed medically necessary by a physician.  The physician must complete and sign a form verifying the requirement for these services.  The injury victim must submit this form and an Attendant Care Services Form to the proper no-fault insurance company in order to receive these benefits.  Our website now has these forms available to download for free from our site.  They are located in the Libary section of the site at www.BuckfireLaw.com

Michigan Bicycle Accident Cases

I am often contacted by clients who are seriously injured in Michigan bicycle accidents.  We are in the middle of summer right now and I seek bikers on the streets constantly throughout the day. The weekends are just incredible with the number of bikers taking to the streets for great exercise and adventure.  However, like any great recreation, there are potential risks and hazards involved.

 

Bicyclists who are injured in Michigan car accidents have legal rights even if the car that struck them was not insured. There are two potential claims arising out of the automobile accident.  The first claim you have is for no-fault benefits, which will cover your damages for loss wages, medical expenses and household chores.  Even if the other driver did not have insurance, but you owned your own automobile which had car insurance, or you were living with a relative had car insurance, you are able to make a claim for no-fault benefits through your automobile insurance company or your relative’s automobile insurance company.  Also, even if you did not have automobile insurance or you were not living with a relative who did not have automobile insurance, you are able to  make a claim for no-fault benefits through the Michigan Assigned Claims Facility.   

 

In addition to making a claim for no-fault benefits, if you had your own automobile insurance which had uninsured motorist coverage or were living with a relative who had automobile insurance which had uninsured motorist coverage, you may be able to  make a claim against the insurance company for uninsured motorist coverage, which will cover all of your non-economic damages, including damages for pain and suffering and disfigurement.  Additionally, you may make a claim for any excess economic damages over and above which you are entitled to receive in no-fault benefits.
