Battle Creek Car Accident Lawyer

A Battle Creek car accident has resulted in injuries for one pedestrian.  The accident occurred on November 1, 2008 when a woman stepped into the road at the corner of Capital Avenue and Union Street.  She was struck by a car that had a blinking yellow light.  She was hospitalized, but there is no word on her condition.

This is a very unfortunate accident, and I hope this woman will be all right.  I hope she can recover fully from her injuries.

Even though this woman was a pedestrian, her accident is still covered by Michigan No Fault insurance.  No Fault insurance will pay for her hospital bills and all reasonable medical expenses for follow-up treatment for injuries caused by this accident.  In addition, No Fault insurance may provide a portion of lost wages, household replacement services, attendant care, and other benefits if they are necessary because of the woman’s injuries.  If her injuries are very serious, she may be able to sue the driver for additional damages not covered by her No Fault insurance.  The best way to determine if she could do this is to speak with an experienced Michigan car accident attorney.

Battle Creek Car Accident Lawyer | Car Hits House

Two Battle Creek women were injured when a car crashed into a house in Pennfield Township.  The car veered off Pennfield Road and ran into the house at about 5:30 on October 27, 2008.  Both the 61-year old driver and her 28-year old passenger were hospitalized for their injuries.  No one was in the house at the time of the crash.  It is not clear what caused the accident.

I am very sorry this accident occurred, and I hope both of the women injured are able to recover completely.

Even though this accident did not involve several cars hitting each other and in fact did not even occur on a road, Michigan No Fault insurance benefits are still available to the driver and the passenger who were injured.  These benefits will cover all medical expenses and a portion of lost wages and may cover other expenses as well.  In addition, the passenger can probably sue the driver if her injuries are severe and she may be able to collect additional damages in that lawsuit.

Hastings Michigan Motorcycle Accident

A Hastings motorcycle accident has left two people injured.  The accident occurred on Sunday when Denny Chase, 76, turned into the path of a motorcycle driven by John Richter, 49, at the intersection of N. Jefferson Street and E. Woodland Avenue in Hastings.  Both men were hospitalized following the accident.

I hope neither of these men were seriously injured in this accident.  I also hope that they have a complete recovery.  This is the second motorcycle accident in Hastings from this weekend that I have read about and it is very unfortunate these accidents occur.

Both Mr. Chase and Mr. Richter are eligible for Michigan No Fault benefits.  These benefits will pay for all medical expenses and any wages lost due to the accident.  In addition, there may be other benefits available to each depending on the severity of their injuries.  If the driver who was free of fault is seriously injured, he may have a claim against the driver who is determined to be at fault, but more information about each drivers’ injuries and about how the accident occurred to determine which, if either, driver has such a claim.  The best way to make this determination would be to consult an experienced Michigan car accident attorney.

Hastings Motorcycle Accident

A Hastings motorcycle accident has left two people injured.  Two people, a man and a woman, were injured when their motorcycle collided with a SUV on Friday.  The accident occurred near Charlton Park Road and M-79 when the SUV turned in front of the motorcycle.  Both motorcyclists were taken to a local hospital for treatment.

Too often, it seems like drivers do not see motorcyclists and the result is accidents like this one.  I would encourage everyone on the road to be more aware of their surroundings and especially to keep a better eye out for motorcycles.  I hope these two motorcyclists have a full and quick recovery.

My law firm often represents motorcyclists who are hurt in accidents with cars.  I frequently encounter motorcyclists who do not know that they are eligible for Michigan No Fault benefits when the accident involves a car.  This coverage can provide an injured person with a wide variety of benefits.  For instance, No Fault benefits will pay for all the medical expenses arising out of an accident, a portion of lost wages if the person has to miss work because of the accident, household replacement services for chores around the house, and attendant care for supervised care required after the person is released from the hospital in addition to other benefits which may be available.  I always encourage motorcyclists to submit their claims quickly because many insurance policies have strict time limits and they could risk losing their benefits if they fail to submit their claims within the time limits.  If a motorcyclist is unsure of how to submit a claim or what claims to make, I always encourage them to speak with an experienced Michigan motorcycle accident lawyer.

Burlington Township Car Accident

A Burlington Township car accident has killed a Union City man.  The driver was killed when his vehicle left the roadway of 10 ½ Mile Road south of M-60 and hit a tree.  He was not wearing a seat belt.  No other details have been released, but police do believe alcohol may have been a factor.

This is a tragic accident and I am very sorry for this man’s family.

As a lawyer whose law firm specializes in representing people who have been injured or killed in car accidents, I often encounter clients who do not realize the full scope of Michigan’s No Fault Act.  For instance, many people think they can receive No Fault benefits only if they have been seriously hurt in a car accident.  This is not true.  No Fault benefits are available in an accident like this, even though the driver has been killed.  If his family makes a survivor loss claim, they can receive a portion of his funeral expenses and may be able to receive a portion of his lost wages.  In addition, if alcohol was involved, the family may be able to pursue a separate dram shop claim against a bar or restaurant that served alcohol to the driver.
