Battle Creek Drag Racing Accident

A teenager was injured in a serious  Battle Creek car crash .  Police are investigating  the crash that occurred due to possible drag racing. Seventeen year old Chase Rupe was a passenger in a Camaro that crashed on Creekview Drive during an alleged drag race. He was taken to Borgess Hospital where he was treated for multimple injuries, including a bruised sternum, cuts to the head and pulled muscles in his neck.

I am very sorry hear that this accident happened and I hope that he is able to recover completely from his injuries.

Michigan car accident victims have a number of legal rights.  For this type of accident, the injured passengers and drivers should submit a claim for Michigan No-Fault insurance benefits.  No-Fault benefits will cover their medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.  Accident victims in Michigan can receive these benefits regardless of who was at fault in the accident.  The injured passengers can claim these benefits even if they did not have an automobile insurance policy.

In addition, the injury victims may be able to file a lawsuit against the person or persons driving the cars.  In this lawsuit, they could claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.  An experienced Michigan car accident lawyer can assist the victim with this type of claim.  Accident victims should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

Battle Creek Car Accident

A Battle Creek car accident has left a teenager with critical injuries.  Sheldon Westworth, 17, of Pennfield underwent surgery for head injuries following a car accident on March 31, 2009 in the parking lot of the high school.  Sheldon Westworth suffered his injuries after riding on the hood of a car and being thrown from it when the car turned.  The car had been going fast enough to squeal its tires at one point.  Police are still investigating the accident.

I am very sorry this accident occurred.  I hope that Sheldon Westworth is able to recover completely from his injuries.

Sheldon’s family should submit a claim for Michigan No Fault insurance benefits.  No Fault benefits will cover Sheldon’s medical expenses, for as long as the expenses continue to be reasonable and necessary, even if this is for the rest of his life.  Attendant care benefits will pay a professional or a family member to provide supervised care to Sheldon after he is released from the hospital.  Case management benefits will pay a case manager a reasonable rate to coordinate Sheldon’s medical treatment.

In addition, Sheldon Westworth or his guardian are likely able to file a lawsuit against the person driving the car.  In this lawsuit, Sheldon’s lawyer would have to prove the driver was negligent and that the driver’s negligence caused Sheldon’s injuries.  An experienced Michigan car accident attorney will be able to discuss Sheldon’s case with his family.

Athens Township Rollover Accident

An Athens Township rollover accident has sent one woman to the hospital.  The accident occurred on M-66 near Q Avenue on November 17, 2008 when Paula Roggow lost control of her SUV and it rolled over.  She indicated she would be going to the hospital in a private vehicle.

I am very sorry this accident occurred.  I hope Paula Roggow is able to fully recover from her injuries.

Even though this was a single-vehicle crash, Paula Roggow is still eligible to receive Michigan No Fault insurance.  No Fault benefits include payment for her medical expenses, payment of a portion of lost wages, household replacement services, and other benefits if her injuries are severe enough to warrant them.  Paula Roggow should consult with an experienced Michigan car accident lawyer to ensure she is claiming all of the benefits she is entitled to.

Battle Creek Pedestrian Injured | Battle Creek Car Accident

A Battle Creek car accident has resulted in a young pedestrian being injured.  Makiya Crump, 11, was following a crossing guard at North Avenue and Frelinghuysen Avenue on November 14, 2008 when a car failed to stop and hit her.  The girl complained of pain in her leg following the accident.

I am very sorry this accident occurred.  I hope she recovers quickly and completely.

Even though as an 11 year old girl, Makiya Crump did not have a policy of No Fault insurance, she can still submit No Fault claims as long as she lives with someone who does in fact have a No Fault policy.  Her No Fault benefits will cover the costs of her medical expenses including those incurred for follow up treatment months or even years after the accident, if medical treatment is still necessary by that time.  In fact, there is no time limit on how long injured people can collect their medical expenses; the only requirement is that the expenses be for medical treatment that is reasonable and necessary in light of the accident.
