Brain Injury Verdict in Lenawee County

A traumatic brain injury victim in a Michigan car accident recieved justice today in a Lenawee County courtoom.  A  jury returned a verdict in a car accident case in favor of the accident vicitm for approximately $2,000,000.00.  This is a substantial verdict in for Lenawee County where jurors are considered conservative when awarding compensation to injury victims.  The accident victim suffered a closed head injury in the accident.

The negligent driver had insurance company with Farm Bureau Insurance Company.  Incredibly, the insurance adjuster offered only $100,000 before the trial to settle this serious injury case.  Well, the jury clearly saw through the smoke and mirror defense and the adjuster grossly underestimated the magnitude of the case, and the tremendous skill of the lawyer for the accident victim.  There will most likely be significant penalties awarded against the Defendant in this case and the insurance company will be probably be required to foot the bill, as it should.

Shelby Township Wrongful Death Case

Attorney Robert J. Lantzy from our law firm recently filed a wongful death lawsuit in the Macomb County Circuit Court on behalf of the estate of Vincent Megna.  Mr. Megna was killed in a September 2005 auto accident at 23 Mile Road and Van Dyke.  The suit was filed against the driver and owner of the other vehicle involved in the accident.  A news story about the accident and the lawsuit was recently publised by the Macomb Daily.  The suit seeks damages for the surviving family as permitted under the MIchigan Wrongful Death Statute.

Michigan Under Insurance Coverage

IA lot of my friends ask me how they can protect themselves if they or their families are involved in a car accident with another driver who does not have enough car insurance to cover the full cost of their injuries and damages.  The answer is simple: buy underinsured motorist coverage.

In Michigan, most insurance companies offer underinsured motorist coverage which will provide protection to you and your family in situations where you are involved in an accident with another car which did not have enough liability insurance to cover your damages and injuries.

In Michigan, the minimum liability policy is only $20,000 per person in an accident.  Therefore, many times, individuals have injuries and damages which far exceed the other driver’s minimum liability policy of $20,000.  In an underinsurance motorist claim, generally, injured persons will have to file a lawsuit against the negligent driver and owner of the other vehicle involved in the accident, as well as make a claim with their own insurance company for the underinsurance motorist coverage.

For example, if individual A has $100,000 in underinsurance motorist coverage and is severely injured due to the negligence of individual B who has only $20,000 in liability coverage, individual A would file a lawsuit against individual B for the $20,000 in liability coverage, and would seek an additional $80,000 in coverage against his or her own insurance company under the underinsurance motorist coverage.

This coverage, along with uninsured motorist coverage, is very inexpensive and probably the most important coverage you can purchase in your auto insurance policy.

If you have any questions on how to make a claim for underinsurance motorist coverage, please call the law firm of Buckfire & Buckfire, P.C. immediately at (800) 606-1717.  You can also learn more from our web site at www.BuckfireLaw.com

There are very strict time limitations in pursuing this type of claim. Therefore, if you are involved in an auto accident, we recommend that you contact an attorney immediately.

As part of any Michigan motorcycle accident case or any Michigan auto insurance claim, it is necessary to obtain the police traffic accident report.  Our firm routinely obtains these for our clients who have been injured in an auto accident.

These are available to you by simply contacting the police agency and requesting the report.  There is usually a small fee for the report.  For an accident that occurred in Zilwaukee, you should request the traffic crash report at the following location:

If your accident was investigated by the Michigan State Police, you need to request the report directly from that agency.  You can download the Michigan State Police form here that you must complete and submit to obtain the Michigan State Police report.  .
