An Ann Arbor car accident on I-94 near Clear Lake Road has resulted in a couple being seriously hurt.  Alexander Hughes, 74, and his wife Caroline, 66, were traveling east on I-95 on November 27, 2008 when he lost control of the vehicle and the car rolled over several times through the median.  The car finally came to rest in the westbound lanes.  Both were taken to UM Hospital where they were listed in serious condition.

Ogemaw County Truck Accident | Ann Arbor Truck Accident Lawyers

A young boy was killed and several members of his family injured in an Ogemaw County truck accident.  The accident occurred near Rose City on November 24, 2008 when icy roads on M-33 caused the father of the family to lose control of his vehicle and slide into the next lane.  A semi truck hit the vehicle broadside.  The 10-year old boy was killed, his 6-year old sister and their father are in serious condition, and the mother and a third child were treated for less severe injuries.  The family was returning from a church retreat to their home in Ann Arbor.

 

This accident is a true tragedy, especially because of what has happened to the family’s children.  I want to extend my sympathies to this family.

Detroit Motorcycle Accident

A Detroit motorcycle accident that occurred after a high-speed chase has ended with the deaths of the motorcyclist and a pedestrian.  On November 4, 2008, a Michigan State Police trooper attempted to pull over a motorcyclist for a traffic violation near East Davison and Conant.  The motorcyclist slowed down when the trooper turned on the emergency lights but then sped up to a high rate of speed and struck a pedestrian that was crossing the street at a traffic light, which the motorcyclist ran.  Both were killed.

 

This is a completely senseless accident and there was no reason for it to occur.  A traffic ticket is simply not worth it.  I feel very bad for both of the families involved.

 

The pedestrian’s family can very likely sue the motorcyclist’s estate for wrongful death.  They may also be able to submit claims to various insurance companies, such as a life insurance company.  Similarly, the motorcyclist may have had motorcycle insurance or life insurance that his family could submit a claim to.  Both families should consult with a lawyer in the near future to ensure they are collecting the full amount of benefits and to determine what options they have in this unfortunate situation.

Northfield Township Car Accident

A Northfield Township car accident has left a South Lyon woman dead after shutting down North Territorial Road for hours on Wednesday.  An elderly South Lyon couple were apparently lost and turned their vehicle onto Beverly Lane to turn around.  The accident occurred when the driver pulled his vehicle out too far into the path of a pickup truck traveling down North Territorial.  Both were taken to Ann Arbor area hospitals.  The wife died later that evening while her husband remains in critical, but stable, condition.

 

This is very tragic and I have nothing but sympathy for this family.  I hope that the man is able to recover from his injuries.

 

My law firm represents people injured in car accidents, and I can tell you this situation is more common than one might think.  The family of this couple should file a claim for No Fault insurance which will cover all the hospital bills and other medical expenses.  In addition, the survivor loss portion of the No Fault claim will give a payment to cover a portion of the funeral costs for the deceased.  Other benefits may also be available.  Finally, the family should seriously consider suing the at-fault driver for wrongful death on behalf of the deceased.  Although the news reports made it sound like her husband was at fault, a full description of the accident, including the police report would be needed to make this determination.  Even if the at-fault driver is determined to be her husband, the wife’s estate still has a valid claim because of the driver-passenger relationship.  Although it may be awkward for a child or grandchild to sue a family member, this situation is quite common and I always remind my clients that the lawsuit is really against the insurance company.  Of course, the decision to sue belongs to the client, not the lawyer.

Marquette County Motorcycle Accident

A Marquette County motorcycle accident in Skandia has resulted in serious injuries for a Nagaunee Township man.  Michael Ryan was driving his motorcycle on U.S. 41 when he collided with a pickup truck.  Patricia Johnson, 73, of Skandia, was crossing the highway when the accident occurred.  Michael Ryan was transported to Marquette General with a head injury.  Sonya Ryan, a passenger in the motorcycle, was also treated for minor injuries and released.  Patricia Johnson sought her own treatment for minor injuries.

 

This is very tragic and I am sad to have read this accident occurred.  I hope everyone involved is able to have a full recovery.

 

Because this accident involved a pickup truck, the Michigan No Fault Act applies.  This law makes available No Fault insurance benefits to everyone injured in the accident regardless of fault.  No Fault insurance benefits will cover all medical expenses, lost wages for three years, and other benefits.  If extended rehabilitation or supervised attendant care is required, Michigan No Fault benefits will cover that expense as well.  In addition, a driver who was free of fault and severely injured may have a claim against a negligent driver.  Whether such a claim exists is usually a complicated question that depends on the nature of the injured driver’s injuries and the circumstances of the accident.  The best way to determine if such a claim exists would be to consult with an experienced Michigan motorcycle accident attorney.
