Sanilac County Car Accident

A Sanilac County car accident has resulted in the deaths of two sisters.  The accident happened on December 25, 2008 near State Road and M-46 in Sanilac Township when the driver lost control of the vehicle and drove it into a ditch.  The accident is believed to have been caused by icy roads.  Diane Cass and Donna Walsh were non-responsive at the scene of the accident, but passed away over the weekend.

 

This is a very tragic accident, especially since it occurred on the holiday.  I want to express my condolences to the family.

 

Michigan No Fault insurance benefits are available to help cover the costs of this accident.  A No Fault survivor loss claim will provide the families with a portion of the funeral costs and with payments for loss of financial support and loss of household services.  Loss of financial support refers to wages or earned income and household services refers to household chores that the accident victims performed.

 

In addition, Diane Cass’s estate could sue the estate of Donna Walsh in a wrongful death lawsuit.  Family members are sometimes hesitant to sue other family members, but if the relative being sued is fully insured, the insurance company will cover any damages that are awarded.  The insurance company will also cover the cost of defending the lawsuit.  It is really just the same as suing the insurance company directly, but the final choice about whether to file a lawsuit belongs to the representative of the estate.
