There was a tragic story in the paper today about a woman killed in a fatal Detroit bus accident this morning, March 2nd, on Detroit’s west side. According to witnesses, a deaf Detroit woman, known locally as Ms. Jazz, was crossing Livernois, near Courtland, when she was hit by a City of Detroit bus being test-driven for safety. The deaf woman did not survive the accident. Police are investigating the accident at this time.

I am very sorry to hear about this accident send my most sincere condolences to the family of the deaf Detroit woman for their loss.

Our Michigan car accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the family members of the deceased woman may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injury victim may be able to file a lawsuit against the persons determined to be at fault in auto accident as well as the City of Detroit. The insurance company for the driver must still cover any injuries. In this lawsuit, the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. The insurance company for the negligent driver typically pays a settlement for this type of case.

Also, the family members of the deceased woman may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident as well as the City of Detroit. At the very least, the surviving family members should hire the best possible lawyer to look into these possibilities.

An experienced Michigan car accident lawyer can assist the family of the victim with this type of claim. The family of the accident victim should not speak with the insurance adjuster for the negligent driver before consulting with an attorney.

If I have been involved in a Michigan car accident, who has to pay for the repairs and damages to my car?

How much you will receive depends on whether you or the other driver was at fault and on what type of collision coverage you had on the car. Your own car insurance pays for the repairs on your vehicle.

What types of Michigan collision coverage are there?

There are three types of Michigan collision coverage for repairs to your car. They are called Limited Collision Coverage, Standard Collision Coverage, and Broad Form Collision Coverage.

What if I did not buy Michigan collision coverage?

If you did not buy collision coverage, you will have to pay for the repairs to your car even if you were not at fault in the accident. You may be able to recover up to $500.00 from the other driver or his insurance company. This is called a minitort claim.

What is a deductible?

This is the amount that you agree to pay toward the cost of repairs before the insurance company steps in to pay the rest.

How much money out of my pocket will I have to pay for the repairs?

This depends on which type of coverage you had at the time of the Michigan car accident. Once you have determined whether you have Limited Collision Coverage, Standard Collision Coverage, or Broad Collision Coverage, you need to determine who was at fault for the accident. Call your car insurance agent for a further explanation of the type of coverage on your vehicle.

Most of you have heard the phrase “No-Fault” but do not know exactly what it means or how it affects you if you are involved in a car accident. You are not alone.

Basically, it means that you can get insurance benefits regardless of whether you or someone else was at fault in the accident. That’s right, you are entitled to insurance benefits even if you were at fault in the accident in the State of Michigan.

Generally, when you are involved in a car accident in Michigan, there are three types of insurance claims. They are classified as:

Car repairs and damages (Payment for repairs to your vehicle)

Bodily injury claims (Payment for your personal injuries)

No-Fault insurance benefits (Payment for wage loss, medical expenses, etc…)

Because Michigan is a no-fault state, you are required to make claims against your own insurance company for car repairs and no-fault benefits. Michigan law also allows you to make a claim against the driver and owner of the car who was at fault in the accident if you suffered personal injuries, such as for pain and suffering and any visible scars or disfigurement. These are called bodily injury claims.
