Alpena Car Accident

An Alpena car accident has resulted in the deaths of two men.  The car accident occurred on February 26, 2009 when icy roads caused a vehicle to roll over in Green Township.  Roy Kraft, 32, of Spruce and James Fettes, Jr., 49, of Alpena were killed in the accident.

I am very sorry this accident occurred.  I want to express my sympathies to the families of these two men for their loss.

Montcalm County Car Accident

A Montcalm County car accident has left an Edmore man with injuries.  Seth Smith was injured on February 18, 2009 when his car crossed the center line of M-57 near Derby Road and crashed.  Seth Smith’s car was the only one involved in the accident.  The cause of the accident has not been determined.

I am very sorry this accident occurred.  I hope that Seth Smith is able to enjoy a full and speedy recovery.

Grand Rapids Car Accident

A woman has been killed in a Grand Rapids car accident.  The accident occurred on February 20, 2009 when the woman lost control of her car and slid across 10 Mile near Shaner Avenue NE and was struck by another vehicle.  It is not certain why the woman lost control of her car.

I am very sorry this accident occurred.  I want to extend my sympathies to this woman’s family for their loss.

Paw Paw Car Accident

A Paw Paw car accident has resulted in severe injuries to a child.  Pauletta Hurd, a 12-year old girl from Paw Paw, was injured after being hit by a car on February 16, 2009.  The accident occurred while she was crossing Michigan Avenue near Gremps Street because the driver of the car had not fully cleared the ice off of his windshield.  Pauletta Hurd was properly in the crosswalk when she was hit.  The car dragged her for a short distance and she had cuts and scrapes on her head and face.

This accident is terrible but thankfully Pauletta Hurd was not killed.  I hope her injuries are not severe, and I hope this driver is held accountable for his carelessness.  I was pleased to see he had been cited for careless driving.

When a pedestrian is hit by a car, many people do not realize the pedestrian can still submit a claim for Michigan No Fault benefits.  This claim can be made for medical expenses, attendant care, household replacement services, and all of the other standard No Fault benefits.

In addition to the claim for No Fault benefits, Pauletta Hurd may be able to file a lawsuit against the driver that hit her.  She could do this if she were very seriously injured.  Because she is a minor, the court would likely appoint a Guardian or Next Friend to handle the lawsuit and protect her interests.  This person is usually the parent or legal guardian of the child.

Van Buren County Car Accident

A Van Buren County car accident has resulted in serious injuries for a Mattawan woman.  Frances Korteway was seriously injured when the driver of another car lost control of his vehicle on Red Arrown Highway and hit her Jeep head-on.  The accident occurred on February 20, 2009.  Frances Korteway had to be extricated from her Jeep with the Jaws of Life and was treated for what appeared to be non-life-threatening injuries.

I am very sorry this accident occurred.  It is not clear how severe Frances Korteway’s injuries are, but I wish her the best for a full recovery.

In an accident like this, there are two distinct things Frances Korteway should do.  First, she should prepare a claim for Michigan No Fault benefits.  No Fault insurance will pay for her hospital bills and follow-up treatment and it will provide wage loss benefits if she has to miss work because of her injuries.  Other benefits may also be available depending on the severity of her injuries.

Second, she should determine whether she is able to file a lawsuit.  Michigan law allows people who are very seriously injured in car accidents to sue the driver who caused the accident.  This lawsuit allows them to collect additional damages for things that No Fault insurance does not cover.  These damages could include lost earnings if the accident victim will be out of work for more than three years or payments for the pain caused by the accident.  A lawyer could help her decide whether she is permitted to file a lawsuit and whether it would be a good thing to do.
