Vergennes Township Plow Truck Accident

Two students were injured in a Vergennes Township plow truck accident.  The students were trying to pull a van out of the snow when they were hit by a private plow truck north of Bailey Drive on Lincoln Lake Avenue on December 23, 2008.  They were injured, but their injuries were not life-threatening.

I am sorry this accident occurred.  Hopefully, these men make a full and quick recovery.

These men should submit a claim for No Fault insurance benefits.  No Fault insurance will cover all reasonable and necessary medical expenses arising from the accident, whether the expenses are incurred immediately or for follow-up treatment.  This benefit alone could save each of them thousands of dollars.  In addition, No Fault insurance will provide payments for lost wages, household replacement services, and other benefits.  If either of them are at all unsure of what benefits they can claim, they should contact a lawyer to help them.

If either of them are severely injured, they may be able to sue the driver of the plow truck for additional damages beyond what No Fault insurance will pay.  Michigan law only allows people with very serious injuries to file lawsuits for car accidents, so they should speak with a lawyer to determine whether their injuries would qualify them to sue.

Vienna Township Roll Over Car Accident

A Vienna Township roll over car accident has injured an Onsted woman.  The accident occurred on December 24, 2008 when a woman driving on I-75 hydroplaned on a pool of standing water near Dodge Road.  The car spun and rolled over, trapping the woman inside.  Her husband and children were able to escape the car.  She was treated for injuries, although it is not clear how seriously she was hurt.

I am very sorry this accident occurred.  I hope this woman is able to fully recover.  Although it may not seem like it, she is actually very lucky.  She and her whole family could easily have been severely injured or even killed.

As a lawyer who represents victims of car accidents, I know many people believe that their car insurance will only cover accidents in which they are not at fault or in which there are two or more cars.  Neither of these are true.  In fact, Michigan No Fault insurance benefits are available regardless of fault and regardless of how many vehicles were involved in the accident.

This woman should submit a claim to her No Fault insurance company.  No Fault insurance will pay for her medical expenses and cover a portion of her lost wages if she has to miss work.  Other benefits will provide payments for household chores if she is temporarily unable to perform them as she normally would.  Other benefits are also available for the very seriously injured.  A lawyer could help walk her or her family through these benefits or help them submit the claim.

Van Buren County Car Accident Lawyers

A Van Buren County car accident left a tow truck driver injured while he was responding to a separate accident on December 22, 2008.  Art Haynes, a driver for Harbor Towing, was hit by a car while operating the rear loading controls on his tow truck in response to an accident near South Haven on I-96.  The car that hit him narrowly missed hitting a state police trooper as well.  It appears Art Haynes suffered only minor injuries.

I am sorry this accident occurred.  I hope Art Haynes is able to recover fully from his injuries.

Even though this accident was caused by icy roads, the Michigan No Fault Act still applies.  No Fault insurance will cover medical expenses and a portion of his lost wages, if he has to miss work because of injuries from the accident.  Although these benefits are all that many accident victims file for when their injuries are minor, Art Haynes and others injured in similar accidents should be aware that medical expenses and wage loss benefits are only two of several claims an accident victim can submit to his or her insurance company.

Allegan County Car Accident

An Allegan County car accident has claimed the life of a Holland teenager.  Jeremy James Plachta, 18, died when his vehicle ran off the road and hit a tree on December 27, 2008.  The accident happened on 66th Street near 144th Avenue in Laketown Township.  The accident is believed to have been caused by foggy weather conditions.

This is a very tragic accident, especially because Jeremy Plachta is so young.  I want to extend my sympathies to his family and friends.

In an accident like this, the victim’s family should file a claim for Michigan No Fault insurance benefits.  No Fault survivor loss benefits will provide Jeremy Plachta’s family with a portion of the funeral cost and this claim may also include payments for loss of financial support and for loss of household services, if Jeremy worked or did chores around the house.  Survivor loss benefits are available regardless of fault, which means they can be collected even though no other car was involved in this accident.

Muskegon Hit and Run Snowmobile Accident

A Muskegon hit and run snowmobile accident has left one man with serious injuries and resulted in possible criminal charges for leaving the scene of an accident.  Levi Coon, 18, was struck by two snowmobiles while pushing a snowblower in the road on December 23, 2008.  He suffered a broken leg.  None of the vehicles stopped.  The drivers were later identified and could face criminal charges for their conduct.

I am very sorry this accident happened, especially since the victim is so young.  I hope he is able to experience a full and speedy recovery.

The most important thing for Levi Coon to worry about is focusing on his recovery.  Neither he nor his parents should have to worry about how they will pay for his medical bills or other costs associated with his accident.  Fortunately, they have legal rights in this situation.

Their legal rights will be determined by the type of snowmobile that struck Levi Coon.  If the snowmobile meets the definition of the term “motor vehicle” as it is used in the Michigan No Fault Act, Levi will be able to collect No Fault insurance benefits.  These benefits cover all reasonable and necessary medical expenses and provide other benefits as well.

If the snowmobile, however, does not meet the definition, the family should strongly consider filing a lawsuit against the drivers of the snowmobiles.  Unlike a criminal trial, this lawsuit will seek payment of medical expenses, pain and suffering, and other money damages instead of jail time or payment of fines to a government agency.  By speaking with a lawyer, Levi Coon could describe the snowmobiles that hit him and the lawyer could better evaluate his case.
