A young boy was killed and several members of his family injured in an Ogemaw County truck accident.  The accident occurred near Rose City on November 24, 2008 when icy roads on M-33 caused the father of the family to lose control of his vehicle and slide into the next lane.  A semi truck hit the vehicle broadside.  The 10-year old boy was killed, his 6-year old sister and their father are in serious condition, and the mother and a third child were treated for less severe injuries.  The family was returning from a church retreat to their home in Ann Arbor.

Bus Accidents | Bay Area Transportation Authority Bus Injuries

I recently read about several people who were injured in Bay Area Transportation Authority (BATA) bus accidents.  Four people have been injured this year due to improper safety belts and harnesses which were either not attached to their wheelchairs or other devices or which were not attached at all.  These injuries particularly affected senior citizens and people with disabilities.  According to the report, BATA officials are responding by inspecting safety equipment and offering additional training to their employees.  Since the injuries that have happened so far this year have been very severe, such as a fractured skull, bruises, and other head injuries, bus passengers should be sure to request all safety measures be used for themselves or people in wheelchairs.

Tuscola County Car Accident

A Tuscola County car accident has resulted in the death of a woman.  The woman was struck by a car on Bray Road north of Willard Road in Arbela Township.  The accident occurred at about 6 pm on November 24, 2008 and there were several neighborhood witnesses. 

 

I am very sorry that this accident occurred.  The news report indicated that the woman was in her mid to late thirties when she died.  She should have had her whole life ahead of her.  My sympathies go out to her family for their loss.

 

In an accident like this, the family should probably do two things as soon as they reasonably can.  First, they should submit a claim for No Fault insurance survivor benefits.  This will provide them with a payment for part of the funeral.  It will also provide payments for loss of financial support and loss of household services, which are her wages or income and the value of household chores she performed, respectively.  Survivor loss benefits can provide near-immediate assistance to a family, especially one facing the loss of income of a working parent or of a homemaker who took care of the house so others did not have to.

Detroit Car Accident | Pedestrian Killed in Detroit Car Accident

A pedestrian was killed in a Detroit car accident on November 23, 2008.  A 48-year old woman was found lying in the middle of East Warren Avenue near Grayton Street.  She was intoxicated and told police she fell, although she is believed to have been hit by a car or assaulted.  Anyone with information about this accident is asked to call the Detroit Police Department at 313-596-1462.

 

This is a heinous accident.  I want to extend my sympathies to this woman’s family.

 

If this woman was in fact hit by a car, her family can file a claim for Michigan No Fault benefits through her insurance policy or the policy of someone she lived with.  Even if she and her family did not have No Fault insurance, her family can still file a No Fault survivor loss claim against the insurance company of the driver of the car that hit her.  And if that person is never identified or if the person is identified but did not have insurance, they can file a claim with the Michigan Assigned Claims Facility.  A lawyer could help her family determine the Order of Priority for filing this claim and assist them in preparing their claim.
