Replacement Service Benefits: Michigan No-Fault Laws

Replacement service benefits under the Michigan No-Fault law provide payment up to $20.00 per day for household assistance to a Michigan car accident injury victim.  It covers things like doing laundry, cooking, housecleaning, and even mowing the lawn if the injured person is unable to do it due to injuries sustained in a Michigan car accident.  The claim is made against your own no-fault insurance carrier and must be supported by a note from your physician indicating that you are unable to do the chores due to the accident.

The benefits are payable for up to three years after the date of the accident.  It is necessary to furnish forms supporting that the services were performed, in addition to your doctors note indicating that you need these services.  The forms to submit to the insurance company can be downloaded for free from the Libary section of our law firm website at www.BuckfireLaw.com

Battle Creek Motorcycle Crash

A 28 year old biker suffered serious injuries when his motorcycle was struck from behind by a car as he was stopped and waiting at a red light.  He was taken to Kalamazoo hospital and is in critical condition.  Police are still investigating the accident.

These types of motorcycle accidents are very disturbing and clearly disprove the common public misperceptions that motorcyclists are usually the cause of their own accidents.  The truth is to the contrary.  Most motorcycle accidents that result in serious injuries and death are caused by passenger vehicles and trucks that either disregard the rights of bikers or simply ignore the danger that their driving causes to bikers.

My firm handles a number of Michigan motorcycle accident cases and most often it is the biker that is abiding the rules of the road and is injured or killed due to a negligent motorist.  Our detailed investigations  often disprove the claims of the negligent drivers that it was the biker who caused the accident.  We hire accident investigators and reconstruction experts to disprove these contentions.

Michigan Brain Injury Program Receives Grant

The Southeastern Michigan Traumatic Brain Injury System was awarded a grant for $1.7 million from the U.S. Department of Education’s National Institute of Disability and Rehabilitation Research.  The program is affiliated with the DMC Rehabilitation Institute of Michigan and offers care to people with brain injuries.

This grant is a great boost for traumatic brain injury and closed head injury patients in Michigan.  My personal injury law firm handles a significant number of brain injury cases, most of which arise from car accidents, motorcycle accidents, fall injuries, and other types of trauma.  Our clients who treat with the best clinics show substantial improvement and have the best prognosis, even if they do not achieve full recovery.  The DMC program already enjoys a great reputation and this grant will certainly help improve the quality of treatment and care provided at that facility.

Pedestrian Accident Injuries: Michigan Car Accident Lawyers

The Michigan summer months are a great time for walking to restaurants, on your errands, and even to work.  Not to mention, of course, a great way to exercise.  Unfortunately, though, many motorists seem to ignore the rights of pedestrians and this often results in tragic pedestrian injury accidents.

There are unique legal rights in Michigan pedestrian accidents that you should be aware of if you were injured outside a vehicle.  You have two potential claims arising out of the automobile accident.

The first claim you have is for no-fault benefits, which covers your damages for loss wages, medical expenses and household chores.  This type of claim is made through your own auto no-fault insurance company, but if you did not have car insurance, there are several other possible sources for to you to obtain coverage.  I will be glad to explain them to you and help you determine which insurance company must pay your benefits.

In addition to making a claim for no-fault benefits, if you had your own automobile insurance which had uninsured motorist coverage or were living with a relative who had automobile insurance which had uninsured motorist coverage, you may be able to  make a claim against the insurance company for uninsured motorist coverage, which will cover all of your non-economic damages, including damages for pain and suffering and disfigurement.  Additionally, you may make a claim for any excess economic damages over and above which you are entitled to receive in no-fault benefits.

There are very strict time limitations in pursuing these type of claims. Therefore, if you are involved in an auto accident, we recommend that you contact our office immediately to discuss your case.
